The contract documents including plans and specifications are on file at the Office of the City of South Charleston; Office of Williamson Shriver Architects, Inc., 717 Bigley Avenue, Charleston, WV 25302; Ohio Valley Construction Employer's Council, Inc., Wheeling, WV; Contractor's Association of WV, Charleston, WV; Kanawha Valley Builders Association, Charleston, WV; Construction Employers Association of NC WV, Fairmont, WV; Parkersburg/Marietta Contractors Association, Parkersburg, WV.

Copies of the documents may be obtained by Material Suppliers and Prime Contractors by depositing $200.00 with the Architect for each set of documents so obtained. The amount of the deposit will be refunded to each actual bidder who returns the plans and specifications in good condition within ten (10) days after the date of opening bids. The deposits will be refunded if documents are returned in good condition; otherwise, deductions will be made in an amount not to exceed the actual cost of reproduction. Those who do not submit bids will forfeit deposit unless sets are returned in good condition at least five (5) days before the bid date. Bidders may obtain documents at their expense from Charleston Blueprint, Charleston, WV, 304-343-1063. These sets or partial sets of documents are not refundable.

Each Bidder must be registered with the West Virginia Department of Tax and Revenue prior to the time and date for Receipt of Bids in order for his Bid to be considered. Each Bidder's registration certificate number shall be written in the space provided on the Form of Proposal. The successful bidder must have or apply for a License in the City of South Charleston.

All applicable bidders are required to be licensed to perform work in the State prior to submitting a bid for this project as required by Chapter 21, Article 11, of the Code of West Virginia. Applicable Bidder's Contractor license number shall be written in the space provided on the Form of Proposal. All applicable bidders will be required to meet all City, State Fire Codes, Fire Building Codes and All OSHA regulations pertaining to the construction of the new building.

The City of South Charleston, South Charleston, WV affords a 2% competitive advantage to bidders with mercantile establishments situated within the City.

The City of South Charleston, South Charleston, WV reserves the right to reject any or all bids and to waive any informalities in the bidding.

All bidders, for the named Packages, shall furnish a satisfactory Bid Bond by a solvent surety company authorized to do business in the State of West Virginia, in an amount equal to five (5%) of the total amount of bid, payable to the City of South Charleston, shall be submitted with each Bid. The successful bidder for Package D will be required to furnish a satisfactory Performance Bond and Payment Bond and the fee for the same shall be included in their bid. All other Packages will be required to furnish a satisfactory Supply Bond and the fee for the same shall be included in their bid

No bid may be withdrawn after the scheduled closing time for the receipt of bids for at least thirty (30) days.

The City of Buckhannon (City) will accept sealed bids for both Contract No. 1, which consists of the purchase, delivery and installation of an emergency backup generator, an automatic transfer switch and a concrete base for the emergency backup generator at the City of Buckhannon's (City) Tennerton Booster Station and Contract No. 2, which consists of the purchase, delivery and installation of a electrical receptacle & plug connection at the City's Raw Water Intake until 4:00 PM EST on September 30, 2015 at City Hall, at which time all received bids will be opened and publically read.

The emergency backup generator, automatic transfer switch, concrete base, electrical receptacle & plug connection and necessary appurtenances shall conform to the contract specifications & drawings and other requirements contained in the Bid Package.

The Bid Package shall be available on September 2, 2015. Interested parties should contact either James S. Hollen, III, PE, City Engineer for the City of Buckhannon, or Susan Dean at 304-472-1651 for pickup options of the Bid Package. All clarifications, questions or comments regarding the contents of the Bid Package must be submitted in writing and either mailed or faxed to the address below or emailed to jay.hollen@buckhannonwv.org. No clarifications and questions will be accepted after 4:00 PM EST on September 16, 2015.

If a Bidder is submitting alternate products to the types of equipment specified in the Bid Package, the Bidder shall provide product literature, including detailed specifications, drawings and information, for review and approval by the City Engineer no later than 4:00 PM EST on September 16, 2015.

Bids for each Contracts must be submitted in a separate sealed (inner) envelope containing the Official Bid Form, and included in a larger sealed (outside) envelope containing the Bid Bond equal to 5% of total base bid with Power of Attorney, evidence of a valid West Virginia Contractors License, Certification of EEO, Drug Free Workplace Conformance Affidavit, and certification of receipt of all Addenda. Both sealed envelopes must have the following information in the lower left hand corner for the respective Contract being bid:

Title V of the Federal Clean Air Act and the state Air Pollution Control Act requires that all major sources and certain minor sources have a permit to operate which states all requirements (e.g. emission limitations, monitoring requirements, etc.) established by regulations promulgated under the aforementioned programs. The Division of Air Quality (DAQ) has determined that the draft/proposed permit renewal referenced herein meets this requirement.

The DAQ is providing notice to the general public of its preliminary determination to issue an operating permit renewal to the following company for operation of the referenced Sanitary landfill:

All written comments submitted by the public and affected state(s) pursuant to this notice must be received by the DAQ within thirty (30) days of the date of publication of this notice. In the event that the 30th/45th day is a Saturday, Sunday, or legal holiday, the comment period will be extended until 5:00 p.m. on the following regularly scheduled business day. Upon notice by the U.S. EPA to the DAQ, prior to the end of the 45-day notice period, the U.S. EPA may choose to hold the 30 day comment period on the draft permit and the 45 day comment period on the proposed permit sequentially. During the public comment period any interested person may submit written comments on the draft permit and may request a public hearing, if no public hearing has already been scheduled. A request for a public hearing shall be in writing and shall state the nature of the issues proposed to be raised in the hearing. The Director of the DAQ shall grant such a request for a hearing if he concludes that a public hearing is appropriate. Any public hearing shall be held in the general area in which the facility is located, after 30 day notice is given. The DAQ will consider all written comments prior to final action on the permit.

On August 3, 2015, Black Diamond Power Company (Black Diamond) applied for revised consolidated purchased power rates. This proceeding is designed to consolidate the various elements of purchasing power into a single annual Commission review. Black Diamond has requested a purchased power surcharge of $0.0122196 per kwh. The total proposed surcharge would result in an annual rate increase of $687,131. Black Diamond also stated that it has accumulated a total under collected balance of $116,245 for its consolidated purchased power costs.

This matter is scheduled for an evidentiary hearing on October 20, 2015, at 9:30 a.m., at the offices of the Public Service Commission in Charleston. Interested persons may attend the hearing and make public comment.

Notice is further hereby given that on September 4, 2015, the Building Commission enacted an Ordinance authorizing and directing the issuance of not more than $2,400,000 in aggregate principal amount of The South Charleston Municipal Building Commission Lease Revenue Bonds (Fire Station No. 1 Project) Series 2015 (the "Bonds") to finance costs of the construction, renovation, expansion, improvement, furnishing and equipping of the real estate, together with the improvements thereon, located at 315, 321 and 323 4th Avenue, South Charleston, West Virginia (the "Property"), to be used by the City of South Charleston (the "City") as a fire station and for other public purposes (the "Project"). The Ordinance further provides for the transfer of the Property from the City to the Building Commission and the leasing of the Property, as constructed, renovated, expanded, improved, furnished and equipped as a result of the Project, by the Building Commission to the City (the "Lease").

The Bonds will be special obligations of the Building Commission payable solely from the revenues, rentals, and other monies received by the Building Commission pursuant to the Lease and any other permitted lease of the Project and other security held pursuant to a bond purchase agreement described below and will not constitute a debt or liability of the City (except as expressly provided in the Lease or the bond purchase agreement described below) or the State of West Virginia.

The Ordinance further provides for a bond purchase agreement to be entered into among the Building Commission, the City and the original purchaser of the Bonds by which the Building Commission will assign to the original purchaser of the Bonds the right to receive rental and other payments under the Lease or other leases permitted by the bond purchase agreement or the deed of trust that will encumber the Property to further secure the owner of the Bonds. The Building Commission will deliver the Bonds in return for the purchase price thereof to be used to pay costs of the Project and costs of issuing the Bonds. Accordingly, the Project will be leased by the Building Commission to the City pursuant to the Lease.

A certified copy of the Ordinance is on file for review by interested persons during regular office hours in the office of the City Clerk of the City of South Charleston, South Charleston City Hall, 401 D Street, South Charleston, West Virginia.

Effective October 1, 2015, the Bureau will revise its acute care hospital reimbursement to provide for interim payments, subject to final settlement, from pool of funds to be directed toward acute care prospective payment system (PPS) hospitals ad hospitals providing tertiary and rural safety net services. This plan amendment will continue to classify hospitals based on U.S. Census classification for rural and metropolitan statistical areas.

The purpose and rationale for this plan amendment is to renew the PPS and tertiary and rural safety net hospitals' supplemental payment pools ad set new pool amounts.

This plan amendment is expected to result in an annual aggregate amount $55,081,739 for fiscal year 2015.
