The undersigned Trustees, by virtue of the authority vested in them by that certain deed of trust dated March 26, 2003, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed of Trust Book 2961, at page 68, Corrina Ruth Ring and Howard T. Ring did convey unto William W. Smith, Trustee, certain real property described in said deed of trust; and the beneficiary has elected to appoint Teays Valley Trustees, LLC as substitute Trustees by a Substitution of Trustee recorded in the aforesaid Clerk's Office; and default having been made under the aforementioned deed of trust and the undersigned Trustees, having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse, 409 Virginia Street East, Charleston, West Virginia 25301 on: March 19, 2015

All that parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in the Town of Glascow, in Cabin Creek District, Kanawha County, West Virginia, being more particularly designated as a Part of Lot No. 24 and a part of Lot No. 23, Block "J", Addition "A", as shown on a certain map, having been made by A.L. Sheldon, Engineer, which map is of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia in Map Book 3, at Page 111, and is designated, "Official Map of Addition A to Glasgow Kanawha County W.Va.", said parcel fronting on the Northeasterly line of Fifth Avenue, as shown on said map, said parcel being more particularly described as follows:
Beginning at an iron pin in the line of a fence, being the Southeasterly corner of a parcel of land, conveyed to Samuel A. Brown and Lula Arbutus Brown, his wife, from J. Cecil Moore et al, by Deed dated September 15, 1969, said iron pin being thirteen (13) feet, more or less, in general Northeasterly direction from the Southeasterly corner of Lot No. 25, as shown on the aforesaid map; thence in a general Northeasterly direction by a line which is approximately (13) feet in a general Northeasterly direction from the dividing line between Lots Nos. 24 and 25, and with the line of the aforesaid fence, a distance of one hundred twenty-six (126) feet, more or less, to an iron pin the Southwesterly line of an alley, shown on said map; thence with said line of said alley; in an up-Kanawha River direction, fifty-five (55) feet to an iron pin; thence, in a general Southerly direction by a line which is parallel to and twelve (12) feet distance from the dividing line between Lots Nos. 22 and 23, as shown on said map, a distance of one hundred twenty-eight (128) feet, more or less, to the Northeasterly line of said Fifth Avenue; and thence, with said line of said Fifth Avenue, in a down-Kanawha River direction, a distance of fifty-five (55) feet to the place of beginning, and consisting of the Northeasterly twenty-seven (27) feet of said Lot No. 24 and the down-Kanawha River twenty-eight (28) feet of said Lot No. 23, the real estate hereby conveyed, being a part of the real estate that was conveyed to Arch C. Moore and Ollie Moore, his wife, by Midwest Steel Corporation, by a certain Deed, dated March 22, 1943, and of record in the said Clerk`s Office in Deed Book 638, at Page 197, the said Ollie Moore having departed this life intestate, leaving as her sole and only heirs-at-law, Jewell C. Harless, Goldie Harless Gray, Blanche Harless Carey, all unmarried, and Emma Harless Camp, wife of Edgar J. Camp, all of whom having conveyed their undivided interests of the said Ollie Moore, in said real estate to the said Arch C. Moore, as "A.C. Moore", by a certain Deed, dated June 16, 1954, and of record in the aforesaid Clerk`s Office in Deed Book 1094, at Page 163; and being the same property conveyed unto Howard T. Ring and Corrina Ruth Ring, his wife, from J.Cecil Moore, et al, by deed dated September 15, 1969, and of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia in Deed Book 1572, at Page 1.
The subject property is made subject to all mineral reservations, restrictions, or other reservations, contained on any prior deed, in the chain of title. 128 5th Avenue,Glasgow, WV 25086
The aforesaid property is SUBJECT TO any and all easements, rights-of-way, conditions, covenants and restrictions of record or in existence.
The sale of the foregoing real property will be made subject to all exceptions, reservations, rights of way, easements, conditions, covenants, restrictions, leases and other servitudes of record, if any, pertaining to said real estate, subject to all matters disclosed by an examination and inspection of the property, subject to any and all unpaid taxes as recorded against said property, and to any further matters announced at said sale. The property is sold subject to an accurate survey at purchaser's expense.
The sale of the foregoing real property will also be made expressly subject to any and all other deeds of trust, judgments, liens, and all other encumbrances of any nature whatsoever, if any, having priority over the deed of trust referred to herein.
The Trustees reserve the right to adjourn the sale, for a time, or from time to time, without further notice, by announcement at the time and place of sale describe above or any adjournment thereof. The Trustees reserve the right to reject any and all bids.
The subject property will be sold in "AS IS" condition. The Trustees shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. The Trustees will deliver a trustees' deed to the purchaser without any covenant or warranty (express or implied) in the form prescribed by W. Va. Code §38-1-6. The Trustees make no representations and warranties about the title of the real estate to be conveyed. If the Trustees are unable to convey insurable or marketable title to purchaser for any reason, purchaser's sole remedy is return of deposit.
TERMS OF SALE: $2,000.00 cash in hand at the time of sale in the form of a certified check or cashier's check made payable to "Teays Valley Trustees, LLC," and the balance in cash closing within 30 days of the date of the sale. Purchaser shall pay for transfer stamps and recording fees. Additional terms of sale may be announced prior to the sale.
