ADVERTISEMENT FOR BIDS

Sealed bids for the City of Dunbar Wastewater System Improvements Project, Wastewater Treatment Plant Lighting Upgrades, will be received by the City of Dunbar, City Hall Building 210 12th Street, Dunbar, West Virginia 25064 until 10:00 a.m. on January 16, 2015 and then publicly opened and read aloud.
The Dunbar Wastewater System Improvements Project, are within the Dunbar city limits located in Kanawha County, West Virginia.
CONTRACT I:
This project includes the upgrade of the existing lighting at the City of Dunbar Wastewater Treatment Plant to an energy efficient lighting system. The work includes renovating/replacing 38 ea. 8' fluorescent fixtures to LED, supplying 86 ea. 8' LED lamp tubes, renovating/replacing 63 ea. 4' fluorescent fixtures to LED, supplying 232 ea. 4' LED lamp tubes, replacing 61 ea. High pressure sodium fixtures with LED fixtures, replacing 5 ea. Incandescent bulbs with LED bulbs, replacing 6 ea. existing photo-cells with new photo-cells, and replacing 19 ea. existing wall switches with passive infrared sensor light switches as outlined in the Form of Proposal
Bidder must agree to commence work on or before a date to be specified in a written "Notice to Proceed" of the Owner and to fully complete Contract I within 90 consecutive calendar days thereafter.

The successful bidder, upon his/her failure or refusal to execute and deliver the contract and bonds required within ten (10) days after he/she has received notice of the acceptance of his/her bid, shall forfeit to the Owner, as liquidated damages for such failure or refusal, the security deposited with his/her bid.
TIME OF COMPLETION AND LIQUIDATED
DAMAGES
Bidder must agree to commence work on or before a date to be specified in a written "Notice to Proceed" of the Owner and to fully complete Contract 1 within 90 consecutive calendar days thereafter. Bidder must also agree to pay as liquidated damages the sum of $500.00 for each consecutive calendar day thereafter as hereinafter provided in the General Conditions.

This Project is being funded wholly by the West Virginia State Revolving Fund (SRF).
WEST VIRGINIA ALCOHOL AND DRUG-FREE
WORKPLACE ACT
West Virginia Code 21-1D-5 provides that any solicitation for the public improvements construction contracts requires each vender that submits a bid for the work to submit at the same time an affidavit of compliance with the bid. The WV Drug Fee Workplace Conformance Affidavit (found in the Certifications section of the Contract Documents) must be signed and submitted in the first envelope as evidence of the vendor compliance with the provisions of Article 1D, Chapter 21 of the West Virginia Code. Failure to submit the signed drug-free workplace affidavit in the first envelope shall result in disqualification of such bid.
NONDISCRIMINATION OF EMPLOYMENT

CONTRACTOR'S LICENSE
All bidders are required to have a West Virginia Contractor's License per Section 21-11-11 of the West Virginia Code.

NOTICE OF FEDERAL AND STATE WAGE RATES
Contractors are required to comply with all the laws pertaining to prevailing wage rates for the State of West Virginia as issued by the Division of Labor and the federal wage rates issued in accordance with the Davis Bacon Act. The contractor will be required to pay the higher of the state or federal wage rates appropriate for each worker classification.
BIDDING METHOD
The bids shall be submitted utilizing a two (2) envelope system, as described in the Information for Bidders section of the Contract Documents.
No bid may be withdrawn for a period of ninety (90) days after the time of the opening of bids.

All Bidders must hold a current WV Contractor License on the date of Bid opening. Any Contractor submitting a bid on this project hereby certifies, indicates, and acknowledges that he/she has a license and meets all the qualifications required by the statues of the State of West Virginia, and subdivision in which the work is to be performed. Note that the bid hold time is 90 days.
DBE REQUIREMENTS
Each bidder must fully comply with the requirements, terms, and conditions as set forth in the contract documents to achieve Disadvantaged Business Enterprise (DBE) participation during the performance of this contract. The bidder commits itself to the program for DBE participation and all other requirements, terms, and conditions of the bid conditions by submitting a properly signed bid.
The bidder agrees to make "good faith efforts" to sub-contract a portion of the total value of the contract to Disadvantaged businesses. This shall be done in compliance with the six (6) good faith efforts as outlined in 40 CFR 31.36(e). Failure to demonstrate good faith efforts may lead to rejection of bids. For the purpose of this program, the term "subcontractor" includes all construction, modification, and service work contracted for by the bidder in the execution of the work under this contract.
NONDISCRIMINATION IN EMPLOYMENT

HUD REQUIREMENTS
A five percent (5%) Bid Bond or certified cashier's check must accompany all Bids. The successful Bidder will be required to furnish a satisfactory Payment Bond and Performance Bond, each for 100% of the contract amount.
The work to be performed under this contract is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended, 12. U.S.C. 1701 u (Section 3). The purpose of Section 3 is to ensure that employment and other economic opportunities generated by HUD assistance or HUD-assisted projects covered by Section 3, shall, to the greatest extent feasible, be directed to low-and very low-income persons, particularly person who are the recipients of HUD assistance for housing.
The parties of this contract agree to comply with HUD's regulations in 24 CFR Part 135, which implement Section 3. Bidder's attention is directed to the Section 3 "Clause" set forth in the contact documents.
Bidders must comply the Drug-Free Workplace Provisions pursuant to West Virginia Code § 21-1D-5.
Bidders on this work will be required to comply with the President's Executive Order No. 11246 entitled "Equal Employment Opportunity" as amended by Executive Order No. 11375 and "HUD Section 109," which prohibits discrimination in employment regarding race, creed, color, sex or national origin.

NOTICE FOR CONSULTING SERVICES

Notice is hereby given by the West Virginia Department of Transportation, Division of Highways, (DOH) Planning Division, that consulting services will be utilized to develop and perform a Planning-Environmental Linkage (PEL) study for the upgrade of WV 9 between Martinsburg and Berkeley Springs.
The work will generally consist of studying alternative corridors previously identified and potential new corridors to be identified and evaluating them to produce a PEL report. The PEL report will be prepared based on Federal Highway Administration and DOH policies and guidelines. This PEL report will be utilized to identify potentially complex environmental challenges at the early planning-level stage of project development and compiling this information in a manner that can be carried forward to assist during the National Environmental Policy Act (NEPA) process.
Method of payment will be lump sum.
A single firm will be selected for this work.
Firms interested in being considered for any or all of these projects must submit a "Letter of Qualification" and unpriced prospectus to Mr. Richard L. Warner, P. E., Director, Planning Division, Division of Highways, Building Five, Room A-863, 1900 Kanawha Boulevard, East, Charleston, West Virginia 25305-0430 prior to 4:00 p.m. on December 22, 2014.
As a minimum, the prospectus shall include the following evaluation factors:

1. Professional qualifications necessary for satisfactory performance of the required services.
2. Specialized experience and technical competence in the type of work required.
3. Capacity to accomplish the work in the required time; personnel qualifications, and present workload.
4. Past performance on contracts with Government agencies and private industry in terms of cost control, quality of work, and compliance with performance schedules.
5. Location in the general geographical area of the project and knowledge of the locality of the project.

In addition to the above evaluation factors, the prospectus shall include, as a minimum, the following items:

1. A completed copy of the Division's Consultant Confidential Qualification Questionnaire, if not already on file with the Planning Division for the calendar year 2014, dated January 1, 2014 or later.
2. Location of office in which the work will be performed.
3. Type of work anticipated to be subcontracted or performed by a sub consultant.
4. Indication of whether a cost accounting system has been maintained and is in effect such that it is capable of segregating and identifying accumulating costs for each job that is performed under cost type projects.
5. The completed copies of the Short List Selection Criteria Technical Evaluation Factor form limited to a single page of data. One loose leaf copy of the form is to accompany the bound unpriced prospectus. The Consultant is to indicate whether or not they hold a valid "Certificate of Authorization" from the West Virginia Board of Professional Engineers to offer engineering services within the state. FINDING OF NO SIGNIFICANT IMPACT

The West Virginia Housing Development Fund has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at West Virginia Housing Development Fund, 5710 MacCorkle Avenue SE, Charleston, WV 25304, and Southern Labor School Foundation, PO Box 127, Kincaid, WV 25119 and may be examined or copied weekdays, 9:00 a.m. to 4:00 p.m.

PUBLIC COMMENTS

Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to Erica L. Boggess, Acting Executive Director, West Virginia Housing Development Fund, 5710 MacCorkle Avenue SE, Charleston, WV 25304. All comments received by January 2, 2015 will be considered by the West Virginia Housing Development Fund prior to authorizing submission of a request for release of funds. Comments should specify which part of this Notice they are addressing.

RELEASE OF FUNDS

The West Virginia Housing Development Fund certifies to HUD that Erica Boggess in her capacity as Acting Executive Director, WVHDF consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows WVHDF to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

HUD will accept objections to its release of funds and the West Virginia Housing Development Fund's certification for a period of fifteen days following the anticipated submission date of January 2, 2015 or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer or other officer of the West Virginia Housing Development Fund approved by HUD; (b) the West Virginia Housing Development Fund has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to HUD at the U. S. Department of Housing and Urban Development, Moorehead Federal Building, 1000 Liberty Avenue, Suite 1000, Pittsburgh, PA 15222-4004. Potential objectors should contact HUD to verify the actual last day of the objection period.

Warbutton and Belva Young Warbutton, his wife, by deed dated July 24, 1933, and of record in the aforesaid Clerk's Office in Deed Book 388, at page 548; thence with the northeast line of said Warbutton lot S. 44° 22' E. 192 feet, passing an iron pin at the top of the river bank, to a point at low water mark on the northwestern bank of Elk River; thence up the said River in a northeasterly direction and binding thereon at low water mark a distance of 50 feet to a point; thence leaving said river and running north 44° 25' W. 190 feet, more or less, to an iron pin the southern boundary line of the right of way conveyed to the County Court of Kanawha County by deed hereinabove referred to; thence with said right of way S. 38.5° W. 50' to the place of beginning, and being a part of Lot "C" as shown on a map made by W. D. Sell, C.E. entitled, "Land of Heirs of Virginia R. Willard, Deed", which said Lot "C" was conveyed to Bessie E. Willard by Robert H. C. Kay and John E. Amos, Special Commissioners, by deed dated August 13, 1932, which said map and deed are of record in the aforesaid Clerk's Office in Deed Book 381, at page 255, and to which reference is hereby made.
And being the same real estate which was conveyed from (a) William R. Morris unto Barbara Ann Camp by deed dated July 24, 1985, and recorded in the aforesaid County Clerk's Office in Deed Book 2009, at Page 62, and (b) John Kelly Lett and Barbara Ann Camp Lett, husband and wife, unto John Kelly Lett and Barbara Ann Camp Lett, husband and wife, by deed dated August 26, 1999, and recorded in the aforesaid County Clerk's Office in Deed Book 2479, at Page 284. The said Barbara Camp Lett died on or about February 14, 2005, and by virtue of the survivorship clause in the above referenced deed, title to the above described property became solely vested in John Kelly Lett. The said John Kelly Lett died on or about May 20, 2013. By virtue of the Order Appointing Administrator entered July 14, 2014 by the Deputy Fiduciary Supervisor of Kanawha County, West Virginia, the Kanawha County Sheriff was appointed Administrator of the Estate of John Kelley Lett (a/k/a John Kelly Lett).
This conveyance is made subject to any and all covenants, restrictions, and easements as the same may appear in instruments of record in the aforesaid Clerk's Office.
The above-described real estate will be conveyed by the undersigned Successor Trustees by deed without warranty of any kind, express or implied, and subject to all prior liens, and further subject to all unpaid real estate taxes or assessments, encumbrances and claims in favor of public service districts / municipal sanitary boards, if any, and also further subject to any covenants, restrictions, conditions, reservations, rights of way and easements of record in the aforesaid Clerk's office and affecting the subject real estate, and without responsibility for or representations as to any items of personal property located thereon; and, any party claiming an interest in any item of personal property is responsible for the removal thereof prior to the date of sale.

The Pocahontas County Commission is requesting bids for a trail maintenance project within the Tea Creek Trail System located adjacent to the Highland Scenic Highway within the Monongahela National Forest in Pocahontas County. The project will include building approximately one (1) mile of new trail, improving drainage by installing such features as drainage dips, geosynthetics and hardening of trail tread utilizing local materials on four (4) miles of existing trails. The use of both mechanical equipment and hand tools will be required to complete this project. The bid should include an estimate package for the project including materials and labor. All trail infrastructure, newly constructed or upgraded by maintenance activities, must be compliant with the "US Forest Service Trail Accessibility Guidelines".
Wages paid for all work must be in accordance with West Virginia Prevailing Wage Codes, or if applicable, Davis-Bacon Act Wage Codes. Successful bidder must also possess a valid West Virginia contractor's license and liability insurance, and may be required to post a performance bond.
