The Cabell County Board of Education, hereinafter referred to as the Owner, invites qualified contractors to submit sealed bids for the New Fields and Field House For Milton Middle School according to Bidding Documents prepared by ZMM, Inc. Architects and Engineers. Sealed bids will be received at the offices of the Owner, 2850 Fifth Avenue, Huntington, West Virginia 25702 until 1:30 pm, local time, on April 11, 2019 at which time and place the bids will be publicly opened and read.
A pre-bid conference will be held at 1:30 pm local time, on March 26, 2019 at the Milton Middle School. Attendance at pre-bid conference is mandatory for prime contract bidders only. Bidders for Testing, Adjusting, and Balancing are not required to attend.

The Randolph County Development Authority, Elkins, West Virginia will receive sealed bids for the construction of the following:
Greenfield Cabinetry Plant Expansion
The Randolph County Development Authority plans to expand an existing building, known as the Greenfield Cabinetry Facility, to provide additional manufacturer facility space. The project contains multiple components including metal building, building interior, site civil, HVAC, plumbing and electrical work.
Exterior work will be focused on the construction of a metal building expanding the existing facility. The scope of work includes a 25,000 square foot addition to the existing Greenfield Cabinetry Building. Construction consists of a pre-engineered metal building over a concrete slab, with concrete foundation walls, concrete footings and drilled concrete shafts. Metal roof is a single-slope shed roof. A portion of the existing exterior wall and loading dock doors and equipment are to be demolished where addition attaches to existing building. Two man-doors and two loading dock doors shall be installed in addition, and pits to be provided for dock levelers (all dock equipment by owner). Plumbing to be roughed-in for future restrooms and maintenance shop (to be constructed by owner). Heating will consist of radiant tube heat. General lighting and electrical is included in the expansion.
Site work includes the installation of storm drains and drop inlets, gravel parking area, asphalt and concrete driveway areas, and other items and appurtenances as outlined in the Plans and Specifications.
Bids shall be submitted on the furnished Bid forms. Bids will be received by the Randolph County Development Authority at its offices at 10 Eleventh Street, Elkins, WV 26241 until 2:00 p.m., (Local Time) March 28, 2019 and then at said office, publicly opened and read aloud. By Order issued on September 6, 2018, the Public Service Commission of West Virginia issued rule amendments to its Rules Governing Electric Utility Net Metering Arrangements and Interconnections, 150 C.S.R. Series 33 (Net Metering Rules). The amendments relate to changes necessitated by the by the repeal of W. Va. Code §24-2F-1-7 and 9-12 revisions to §24-2F-8 including cross subsidization and disconnect issues.

Initial and reply written comments on the Net
Metering Rules were received by October 8, 2018, and November 8, 2018, respectively. The Commission determined that comments pertaining to blank meter sockets, dual meters, and non-standard meters required further comment and explanation. The Commission, therefore, will reopen the comment period to conduct a public comment hearing on the comments and reply comments received on these issues. The hearing will take place at 9:30 a.m. on Tuesday, April 30, 2019, in the Howard M. Cunningham hearing room at the Public Service Commission, 201 Brooks Street, Charleston, West Virginia. The reopened comment period will close at the end of the day on April 30, 2019. The Companies, and any other Net Metering Task Force participants wishing to appear at the hearing and make comments, shall file -re-filed initial testimony on or before April 5, 2019, at 4:00 p.m. Pre-filed reply testimony shall be filed on or before April 19, 2019, at 4:00 p.m.

On May 22, 2018, Officers of the Metropolitan Drug Enforcement Network Team seized a 2008 Jeep Grand Cherokee, VIN: 1J8HR58288C117761 and $6,513.00 (Six Thousand, Five Hundred and Thirteen Dollars), in United States Currency, at 904 Hamlet Way, Charleston, Kanawha County, West Virginia. 2008 Jeep Grand Cherokee, VIN: 1J8HR58288C117761 and $6,513.00 (Six Thousand, Five Hundred and Thirteen Dollars), in United States Currency, constitutes a conveyance which was used, had been used or was intended for use, to transport or in any manner to facilitate the transportation, sale, receipt, possession, or concealment of a controlled substance, in violation of West Virginia Code, Chapter 60A, and moneys and/or a thing of value furnished or intended to be furnished, in violation of West Virginia Code, Chapter 60A, by any person in exchange for a controlled substance and/or proceeds traceable to such an exchange, and/or moneys used, or which have been used, or which are intended to be used to facilitate any violation of West Virginia Code, Chapter 60A, and/or the laws of the State of West Virginia. 2008 Jeep Grand Cherokee, VIN: 1J8HR58288C117761 and $6,513.00 (Six Thousand, Five Hundred and Thirteen Dollars), in United States Currency was found in possession and/or control of George Mboya and Jessica Facemyer-McDonald and at the time of the seizure, George Mboya claimed ownership of the same. Notice is hereby given that the Town of Cedar Grove, a municipal corporation, will hold a hearing before the final vote on a proposed ordinance, the principal object of which is the increase of sewer rates for customers of the sewer system operated by the Town of Cedar Grove. The proposed increased rates are necessary for the Town to evaluate and upgrade the Town's Sewage System which is under an administrative Order issued by the West Virginia Department of Environmental Protection. Specifically, the Town will perform smoke testing and inspection of the entire collection system, upgrade all of its pumping stations, prepare an asset management plan and update the Combined Sewer Overflow - Long Term Control Plan. The increase for customers based on an average usage of 3,400 gallons of water (currently $60.77) is $65.02 or 7.00%. The average increase for customers in Cedar Grove is 7.00% or about $4.25 more for 3,400 gallons of water used. For the first 2,000 gallons, the proposed rate will be $20.12 per 1,000 gallons; for the next 3,000 gallons, the new rate will be $17.71 per 1,000 gallons; for the next 20,000 gallons, the new rate will be $11.65 per 1,000 gallons and for all over 25,000 gallons, the new rate will be $8.31 per 1,000 gallons. Specifically, for the first 2,000 gallons, the new rate will be $40.24 per 2,000 gallons; for 3,000 gallons, the new rate will be $57.95; for 4,000 gallons, the new rate will be $75.66; for 5,000 gallons, the new rate will be $93.37; for 6,000 gallons, the new rate will be $105.02; for 7,000 gallons, the new rate will be $116.67; for 8,000 gallons, the new rate will be $128.32; for 9,000 gallons, the new rate will be $139.97 and for 10,000 gallons, the new rate will be $151.62. The minimum bill will be $40.24 at 2,000 gallons. A flat rate charge for customers with nonmetered water supply is $84.51 based on 4500 gallons of water usage. The final vote on adoption of said proposed Ordinance shall be held in the Council Chambers of the Town of Cedar Grove on Tuesday, April 2, 2019 at 6:00 p.m. Interested parties may appear and be heard at such time with respect to the passage of the proposed Ordinances. Notice is hereby given by the West Virginia Department of Transportation, Planning Division, that consulting services will be utilized for the Statewide Traffic Counting Program. These services include Statewide traffic data collection for:
1. Coverage counts program where the traffic data will be collecd for 1/3 of the state each year for three consecutive years. The traffic data include volume and classification counts.
2. Statewide interstate and ramps which include volume and classification counts. The interstate counts will be collected twice every year, in Spring and in Fall while the ramps counts will be collected once every year.
3. Special counts which include turning movement counts, volume and classification counts. The special counts are to be collected year around as requested.

Method of payment will be lump sum per assignment or specific rate of pay.

Multiple firms may be selected for this work.

Firms interested in being considered for any or all of these projects must submit a "Letter of Qualification" and unpriced prospectus to Mr. C. Elwood Penn, IV, P. E., Director, Planning Division, Division of Highways, Building Five, Room A-740, 1900 Kanawha Boulevard, East, Charleston, West Virginia 25305-0430 prior to 4:00 p.m. on April 2, 2019.

As a minimum, the prospectus shall include the following evaluation factors:

1. Professional qualifications necessary for satisfactory performance of the required services.

2. Specialized experience and technical competence in the type of work required.

3. Capacity to accomplish the work in the required time; personnel qualifications, and present workload.

4. Past performance on contracts with Government agencies and private industry in terms of cost control, quality of work, and compliance with performance schedules.

5. Knowledge and understanding of the scale and requirements of non-traditional transportation projects throughout the entire project life cycle.

In addition to the above evaluation factors, the prospectus shall include, as a minimum, the following items:

1. A completed copy of the Division's Consultant Confidential Qualification Questionnaire, if not already on file with the Division of Highways for the calendar year 2019, dated January 1, 2019 or later.

2. Location of office in which the work will be performed.

3. Type of work anticipated to be subcontracted or performed by sub consultant(s).

5. The completed copies of the Short List Selection Criteria Technical Evaluation Factor form limited to a single page of data. One loose leaf copy of the form is to accompany the bound unpriced prospectus. The Consultant is to indicate whether or not they hold a valid "Certificate of Authorization" from the West Virginia Board of Professional Engineers to offer engineering services within the state. Cross referencing on this form to other parts of the prospectus is not acceptable.

A single "Letter of Qualification" and unpriced prospectus is required. All evaluation factors as noted herein before will be given equal consideration in the selection process, unless a project specific weighting of the evaluation factors is shown in the Notice for Consulting Services.

Prior to entering into contract negotiations, the selected firm and any sub consultants shall submit a current audited overhead rate computation performed by a State or Federal government agency or independent CPA firm. The submitted overhead audit shall contain a detailed exhibit of the computations with all applicable eliminations and references. The audit shall be done in accordance with Government Auditing Standards issued by the Comptroller General of the United States and all eliminations required by the Federal Acquisition Regulations will be made. This requirement will be waived for the selected firm or any sub consultant when its portion of the fee for the project is less than One Hundred Thousand Dollars ($100,000.00). In such instances, a company computed overhead rate may be utilized.

This meeting will provide an overview of the project, the temporary traffic control requirements and potential impacts to traffic during construction.

A short presentation will be made. The scheduled public meeting is from 4:00 to 7:00 p.m. and the public will be afforded the opportunity to ask questions and give written comments on the project throughout the meeting. A handout with project details will be available at the meeting and on the WVDOH Website.

The Town of Rainelle, located in Greenbrier County, West Virginia is in the process of obtaining the services of a consulting engineer to evaluate and make recommendation regarding the Town's existing water storage facilities. The consultant will be required to (1) investigate the condition of each water storage facility and prepare associated preliminary engineering report, (2) design and prepare construction drawings, bid specifications and bid documents, (3) evaluate bids received and make recommendation of award, (4) monitor and inspect construction activities to insure compliance with plans and specifications, (5) review and approve contractor's pay estimates and (6) any other services needed by the Town for the implementation of this project. All consultants interested in being considered for this project must submit a proposal detailing qualifications, technical expertise, management and staffing capabilities and related prior experience.

The purpose of the competitive process is to objectively select the consultant who will provide the highest quality of service at a realistic fee. Accordingly, technical qualifications and experience will be weighed heavily.

If a portion of the contract is subcontracted, then "positive efforts" must be made to subcontract to Minority/Women-Owned Businesses. This shall be done in compliance with the six (6) affirmative steps as outlined in 40 CFR 33.240.

COMPREHENSIVE EDUCATIONAL
FACILITIES PLAN (CEFP) CONSULTANT

The Lincoln County Board of Education intends to contract with a firm to create a digital Comprehensive Educational Facilities Plan. Any firm or individual interested in responding to this request but lacking abilities to fulfill any or all portions of the scope of work may partner with another firm in order to be an eligible participant. The completed plan will be submitted to the School Building Authority of West Virginia (SBA) and the West Virginia Board of Education (WVBE) no later than August 1, 2020 and shall reflect a ten-plus year planning period.

This plan is required by both SBA Statute and WVBE Policy as created by the WV Legislature. As such, the SBA and the WVBE may monitor the planning process and will set deadlines for the CEFP process. Specific deadline submission requirements and planning procedures will be monitored by the SBA and progress reports must be submitted to the SBA as directed. The firm(s) will be evaluated using the state procurement process as outlined in WV Code§5G based upon suitability to complete this work and upon the quality of information contained in the response to this RFP.

The SBA and WVDE have partnered with two contractors, Dude Solutions and Alpha Facilities Solutions, to provide a digital template database and an electronic facility evaluation instrument to house the CEFP. The selected firm(s) will be required to meet general requirements relating to data gathering and entry. The selected firm(s) must also attend a Planning Seminar in Charleston, WV hosted by the SBA and the WVBE prior to initiating the planning process. The date and time for the seminar are TBD.

Once all proposals are received, they will be reviewed and points will be assigned as illustrated in the full RFP. After all points have been assigned, the firm(s) with the highest points will be contacted to begin fee negotiations. If no suitable fee can be agreed upon, the county will then contact the firm(s) with the second highest points and so on until a successful fee negotiation can be achieved. The successful firm(s) will then enter into a professional services contract with Lincoln County and begin work at the agreed upon time.

The Hamlin Public Service District (PSD), Hamlin, West Virginia, is in the process of selecting a Project Architect/Engineer to provide certain architectural/engineering services for the following project: Wastewater System Improvements Project. Professional services will include the following items: design of wastewater system improvements, preparation of bidding and contract documents; participation in the solicitation and evaluation of bids; assistance in obtaining easements and other property if necessary; surveying and mapping; preparation of all necessary permit applications; construction administration and construction inspection. Procurement of said services shall be made in accordance with section 5G of the West Virginia State Code. Contracts are to be awarded on a lump sum/fixed fee basis.

All engineering firms interested in being considered for this project must submit five (5) copies of their proposal detailing technical expertise, qualifications, and related prior experience. The goal of the competitive process is to objectively select the firm which will provide the highest quality of service at a realistic fee. Accordingly, technical qualifications and experience will be weighed heavily. A committee of representatives as determined by the Hamlin PSD shall evaluate the statements of qualifications and performance data and other material submitted by interested firms and select a minimum of three firms which, in their opinion, are best qualified to perform the desired service. Interviews with each firm selected shall be conducted and the committee shall conduct discussions to evaluate the presented information. The committee shall then rank in order of preference no less than three professional firms deemed to be the most highly qualified to provide the services required, and shall commence scope of services and price negotiations with the highest qualified professional firm for said services. Should the committee be unable to negotiate a satisfactory contract with the professional firm considered to be the most qualified, at a fee determined to be fair and reasonable, price negotiations with the firm of second choice shall commence. Failing accord with the second most qualified professional firm, the committee shall undertake negotiations with the third most qualified professional firm. Should the committee be unable to negotiate a satisfactory contract with any of the professional firms in order of their competence and qualifications, it shall continue negotiations in accordance with these procedures until an agreement is reached.

Attention is directed to the fact that the proposed project may be undertaken using various Federal and State funding sources, examples of which are: Small Cities Block Grant Program (SCBG) from the U.S. Department of Housing and Urban Development through the State of West Virginia, USDA -Rural Utilities Service (RUS), the West Virginia Infrastructure and Jobs Development Council (IJDC), the United States Department of Commerce, Economic Development Administration (EDA), the Appalachian Regional Commission (ARC), and the West Virginia Department of Environmental Protection (DEP). All work shall be performed in accordance with the regulations issued by the federal funding source and the State of West Virginia pertaining thereto. The selected firm will be required, if applicable, to comply with Title VI of the Civil Rights Act of 1964, President's Executive Order 11246, Section 109 of the Housing and Urban Development Act of 1974, Section 3 of the Housing and Urban Development Act of 1968, Conflict of Interest Statement, Access to Records provisions, and the Uniform Relocation Assistance and Real Property Acquisitions Policies Act of 1970. The selected firm must also fully comply with the Minority/Women-Owned Business Enterprise and Affirmative Action requirements. If a portion of the project is subcontracted, then "positive efforts" must be made to subcontract to Minority/Women-Owned Businesses. This shall be done in compliance with the six (6) affirmative steps as outlined in 40 CFR 33.240.

The Hamlin PSD will afford full opportunity to minority business enterprises to respond to this request and will not discriminate against any interested firm or individual on the grounds of race, creed, color, sex, age, handicap or national origin in the awarding of this contract.

Attention is directed to the fact that the Hamlin PSD will not enter into an agreement for engineering services for this project unless, in the PSD's opinion, funding is imminent or actually received which is sufficient to allow the PSD to complete the project. If sufficient funding is received or anticipated, this contract will be awarded to the responsible offeror whose proposal is within the competitive range and determined to be the most advantageous to the Hamlin PSD, price and other factors considered. The PSD will conduct negotiations on an individual project basis following the hierarchy of rankings as determined during the selection process. ENVIRONMENTAL CONSULTING SERVICES

Upon receiving a Brownfields Coalition Assessment Grant from the U.S. Environmental Protection Agency, WV Region 2 Planning & Development Council (Region 2) is seeking an environmental consulting firm to provide professional and technical services necessary to undertake environmental assessments and other related activities. The majority of work will occur along the Interstate 64 Corridor in the Metro Valley region of West Virginia (includes the counties of Cabell, Kanawha, Putnam, and Wayne); some assessments may occur in the counties of Boone, Clay, Lincoln, Logan, Mason, or Mingo. The selected environmental consulting firm will update site inventory and site prioritization of previously selected brownfield sites, perform an agreed upon number of Phase I and Phase II Assessments in accordance with U.S. Environmental Protection Agency standards, undertake site characterizations in accordance with EPA Brownfield Standards, produce Remedial Action Plans and/or Site Reuse Plans, conduct community outreach, and generate final reports compiling all data with conclusions and recommendations for site clean-up. This project is funded with $600,000 in federal funds through the United States Environmental Protection Agency, which is 100% of the total project cost; the majority of funding will be used for environmental services.

Scope of Services:
Task 1: Update Site Inventory & Site Prioritization - A comprehensive site inventory for 70 properties along the Interstate 64 Corridor in the Metro Valley region of West Virginia has already been compiled by the community partners. Based on site selection matrices, 12 of the inventoried sites were considered high priority for potential redevelopment for "shovel-ready" sites. This inventory will be updated, with additional sites of interest and site prioritization efforts conducted throughout the project. Site eligibility and prioritization will be established, followed by the perceived or known need to address environmental and related health and safety issues; existing infrastructure conditions, potential site redevelopment, and job creation associated with each site will also be examined. Site prioritization will be conducted using a previously developed scoring system that accounts for factors including infrastructure conditions, zoning status, and local community characteristics (residential, mixed-use, commercial, industrial, etc.). Task Outputs include an updated and expanded site inventory.

Task 2: Environmental Site Assessment Activities - Selected sites will be subject to Phase I and/or Phase II Environmental Site Assessments (ESA's), conducted by a contracted qualified environmental professional. Phase I ESA's will be conducted using EPA's All Appropriate Inquiry Rule (40 CFR Part 312) and ASTM E1527-13 "Standard Practice for Environmental Site Assessment: Phase I Environmental Site Assessment Process." Phase II ESA's will be conducted using ASTM E1903-11 "Standard Practice for Environmental Site Assessments: Phase II Environmental Site Assessment Process." For each Phase II ESA conducted, a Sampling and Analysis Plan (SAP) and Health and Safety Plan (HASP) will be compiled. Task Outputs include up to 10 Phase I ESA's (average size 10 acres), up to 8 Phase II ESA's, including 8 SAP's and 8 HASP's, and associated ACRES reporting.

Task 3: Site Reuse & Remedial Planning - Completed Phase II ESA's will be used to develop Remedial Action Plans on sites where remedial actions are warranted for future site redevelopment to occur. Each Remedial Action Plans will evaluate the site for human health and ecological risk factors, future reuse plans, specific contaminants of concern, and site remediation alternatives. Task Outputs will include up to 5 Remedial Action and/or Site Reuse Plans.

Task 4: Community Outreach - Through previous and on-going efforts in compiling a site inventory, numerous businesses and property owners, site developers, and community partners have been engaged throughout the Metro Valley region, identifying priority sites and discussing strategies to move these sites toward future development. An informational brochure outlining project details will be developed and distributed throughout the Metro Valley. Community-based site inventory and prioritization meetings will occur quarterly throughout the project, and will be held at various locations throughout the Metro Valley area to ensure maximum local community participation. Task Outputs include 12 community meetings.

Procurement of said services shall be made in accordance with section 5G of the West Virginia State Code. Failing accord with the second most qualified professional firm, the committee shall undertake negotiations with the third most qualified professional firm. Should the committee be unable to negotiate a satisfactory contract with any of the professional firms in order of their competence and qualifications, it shall continue negotiations in accordance with these procedures until an agreement is reached.

All work shall be performed in accordance with the regulations issued by the federal funding source (United States Environmental Protection Agency) and the State of West Virginia pertaining thereto. The selected firm will be required, if applicable, to comply with Title VI of the Civil Rights Act of 1964, President's Executive Order 11246, Section 109 of the Housing and Urban Development Act of 1974, Section 3 of the Housing and Urban Development Act of 1968, Conflict of Interest Statement, Access to Records provisions, and the Uniform Relocation Assistance and Real Property Acquisitions Policies Act of 1970. The selected firm must also fully comply with the Minority/Women-Owned Business Enterprise and Affirmative Action requirements. If a portion of the project is subcontracted, then "positive efforts" must be made to subcontract to Minority/Women-Owned Businesses. This shall be done in compliance with the six (6) affirmative steps as outlined in 40 CFR 33.240.

Region 2 will afford full opportunity to minority business enterprises to respond to this request and will not discriminate against any interested firm or individual on the grounds of race, creed, color, sex, age, handicap or national origin in the awarding of this contract.

Attention is directed to the fact that Region 2 will not enter into an agreement for consulting services for this project unless, in Region 2's opinion, funding is imminent or actually received which is sufficient to complete the project. If sufficient funding is received or anticipated, this contract will be awarded to the responsible offeror whose proposal is within the competitive range and determined to be the most advantageous to Region 2, price and other factors considered. Region 2 will conduct negotiations on an individual project basis following the hierarchy of rankings as determined during the selection process. However, Region 2 reserves the right to accept or reject any and all proposals.

NOTICE is hereby given that Mountaineer Gas Company, a public utility, has filed with the Public Service Commission of West Virginia a tariff containing a requested increase in rates and charges for furnishing natural gas service to approximately 218,000 customers in Barbour, Berkeley, Boone, Braxton, Brooke, Cabell, Calhoun, Clay, Doddridge, Fayette, Gilmer, Grant, Greenbrier, Hancock, Hardy, Harrison, Jackson, Jefferson, Kanawha, Lewis, Lincoln, Logan, Marion, Marshall, Mason, McDowell, Mercer, Mineral, Mingo, Monongalia, Monroe, Nicholas, Ohio, Pendleton, Preston, Putnam, Raleigh, Randolph, Ritchie, Roane, Summers, Tucker, Tyler, Upshur, Wayne, Wetzel, Wirt, Wood, and Wyoming Counties in West Virginia.

The proposed increased rates and charges will become effective Friday April 5, 2019, unless otherwise ordered by the Public Service Commission, and will produce, on a total Company basis, $13,089,000 annually in additional revenues, or an overall average increase in revenues of approximately 6.15%. The average monthly bill for the various classes of customers will be changed as follows:

Our water system recently violated a drinking water standard. Although this is not an emergency, you, as our customers have the right to know what happened, what you should do, and what we are doing to correct the situation.

We routinely monitor for the presence of drinking water contaminants. Test results for 10/1/2018 and 12/31/2018 show that our system exceeds the standard or maximum contaminant level (MCL) for Haloacetic Acids.

The average level of Haloacetic Acids over the last four quarters was 68.15 µg/L at RUBES HOLLOW (BUFFLICK) location. The standard for Haloacetic Acids is 60.0 µg/L.

What should I do?
You do not need to use an alternative (e.g. bottled) water supply. However, if you have specific health concerns, it is recommended that you consult with your doctor.

What does this mean?
This is not an immediate risk. If it had been,k you would have been notified immediately. However, some people who drink water containing Haloacetic acids in excess of the MCL over many years may have an increased risk of getting cancer.

What happened? What is being done?

We did 4 tests in 2018. The first test was over the MCL but the other 3 tests were below the limit. The yearly average was above the limit. We have taken steps - flushing and reduced chlorine level to bring test results down.

The undersigned Substitute Trustee, by virtue of the authority vested by that certain Deed of Trust dated November 2, 2006, and of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Trust Deed Book 3409, at page 542. In which William H. Wade, Jr. and Ellen E. Wade, did convey unto Jeremiah F. Wade, Jr. and Ellen E. Wade, his wife, by virtue of a deed from Paul F. Whitlock, dated March 31, 2006, and being duly of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia in Deed Book 2656 at page 158.
TERMS OF SALE:

1. $5,000.00 in Cash or certified funds on the day of sale with the balance due in 30 days of sale.

2. The sale of the property will be made subject to all matters having priority over the deed of trust referred to herein including but not limited to any and all easements and taxes against said property, all prior liens, encumbrances, leases, restrictions, covenants, conditions, rights of ways and easements of any nature whatsoever, Subject to the redemption rights of the Internal Revenue Service as set forth in 11 U.S.C. §7425.

3. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes, presently owed or due.

4. Subject property is sold "
AS IS" condition. The Substitute Trustee makes no representations and warranties of any kind or character including but not limited to the condition of the real estate or the title to the real estate conveyed. real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservation which may be a matter of record in the aforesaid Clerk's Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

5. The beneficiary of the Deed of Trust and holder of the note thereby secured reserves the right to submit a bid for the property at the sale, which may be in the form of a credit bid.

6. All other terms as may be announced at time of sale.

7. FEDERAL TAX LIEN: In the event that there are any Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

8. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
