ABSTRACT OF BOND ORDINANCE
AND NOTICE OF
PUBLIC HEARING

Pursuant to the provisions of West Virginia Code Chapter 6, Article 9A, Section 6, and in accordance with the provisions of West Virginia Code Chapter 8, Article 16 and Chapter 22C, Article 2, as amended, you hereby notified that a special meeting of the Council (the "Council") of the City of Montgomery (the "City") will be held on the 21st day of August, 2017, to consider for enactment an Ordinance entitled "Ordinance Authorizing the Acquisition, Construction and Equipping of Improvements and Extensions to the Existing Public Sewerage Facilities of the City of Montgomery and the Financing of the Cost, Not Otherwise Provided Thereof, Through the Issuance by the City of Not More Than $991,570 in Aggregate Principal Amount of Sewer Revenue Bonds, Series 2017 (WV CWSRF Program), in One or More Series; Providing for the Rights and Remedies of and Security for the Registered Owner of Such Bonds; Authorizing Execution and Delivery of All Documents Relating to the Issuance of Such Bonds; Approving, Ratifying and Confirming a Bond Purchase Agreement Relating to Such Bonds; Authorizing the Sale and Providing for the Terms and Provisions of Such Bonds; and Enacting Other Provisions Relating Thereto" (the "Ordinance"), to authorize the issuance of Sewer Revenue Bonds, Series 2017 A and Series 2017 B (collectively, the "Bonds"), of the City in amounts totaling not to exceed $991,570. The Bonds will provide a portion of the funds to finance the cost of the acquisition, construction and extension of additions, betterments and improvements to the existing wastewater treatment system of the City.

The principal amount of the Series 2017 A Bond will be $752,237. The entire amount of the principal of and interest on the Series 2017 A Bond will be paid solely and only from the revenues received from operation of the sewer system of the City to be amortized over a period of 38 years. The Series 2017 A Bond will bear interest at a rate not to exceed 0.25% per annum, plus an SRF Administrative Fee not to exceed 0.25% per annum.

The principal amount of the Series 2017 B Bond will be $239,333. The principal amounts advanced under the Series 2017 B Bond will be deemed forgiven on the 30th day of June in the fiscal year in which advanced. The Series 2017 B Bond shall be deemed no longer outstanding after the last advance is forgiven. The Series 2017 B Bond shall bear no interest.

A copy of the Ordinance and a copy of the plans and specifications of the Project are available for examination by any interested person at the Montgomery City Hall, 706 Third Avenue, during regular office hours of such office, which are from 8:30 a.m. to 4:00 p.m., Monday through Friday.

The meeting will be held at the City Hall at 706 Third Avenue, Montgomery, West Virginia, on the 21st day of August, 2017, at 6:00 p.m., and any person or persons interested may appear before Council and be heard as to whether or not the Ordinance shall be put into effect. Council will hear all suggestions, protests and objections to the issuance of the Bonds.

The Mandatory Pre-Bid Conference will be held at 10AM on August 22, 2017 at Kanawha County Schools Operations/ Division Headquarters (Crede) followed by Mandatory Site Visits at Ben Franklin Career Center 500 28th St. Dunbar, WV 25064 and Piedmont Elementary School 203 Bradford St. Charleston, WV 25301. Any Prime Bidder who fails to attend the Pre-Bid Conference will cause that Bid to be disqualified.

After the Prebid Conference, all questions must be submitted in writing to
ZDS Design/ Consulting Services. See project personnel for the fax number and email addresses. No verbal questions will be accepted.

The Kanawha County Board of Education reserves the right to reject any or all bids, to waive any formalities therein, and award contract to the Bidder in which the Owner determines to be in their best interest.

Proposals are to be made on the forms bound in the Project Manual in the manner designated in the specifications. Proposals must be enclosed in two (2) envelopes (outer and inner) both of which shall be sealed and clearly labeled to indicate the project and to guard against opening prior to time designated for the receipt of bids. Identify the Bidder's Name and the Name of the Project on the outside of both envelopes with the notation:

Provide one original and two copies to the address printed below. Proposals must be accompanied by a Bid Bond in favor of the Kanawha County Board of Education for an amount equal to five percent (5%) of the total amount of the proposal and must be delivered at the place designated on or before the date and hour named.

Within ten (10) days of award, the successful Bidder will be required to furnish a satisfactory Performance Bond and Payment Bond and the fee for the same shall be included in the bid. No bid shall be waived or returned because the Bidder failed to or cannot comply with any requirements as set forth in the plans, specifications, or any applicable statutes of the United States, the State of West Virginia, and/or local ordinances.

Bidders on this work will be required to comply with the President's Executive Order No. 11246.

No bid may be withdrawn for a period of sixty (60) days after the time of the opening of the Bids. The Kanawha County Board of Education reserves the right to reasonably negotiate this project.

All Prime Contractors and Subcontractors shall be licensed in compliance with West Virginia Code Chapter 21, Article 11 (Contractor Licensing Act). All Prime contractors shall include their West Virginia Contractor License Number in their Bid Proposal.
The successful Bidder will be required to execute a contract, comply with all rules and regulations of the West Virginia Workers' Compensation Laws, and provide evidence of insurance coverage to the minimum limits required by the contract documents.

Each Contractor shall provide a Contractor's Qualification Statement, with the Bid proposal.

All proposals must comply with Chapter 21, Article 11 of the West Virginia Code.
As of July 01, 2014, Bidders are Required to Comply with the West Virginia Senate Bill No.376 Requiring Employees Working on Public Projects to Complete a 10-hour OSHA Approved Construction Safety Training Course. Bidders are Required to Provide a Copy of the OSHA Approved Construction Safety Training Course for each Employee Including the Employee's Name, Date the Training was Completed and the Training Provider.

Bidders are Required to Comply with the West Virginia Drug Free Workplace Code §21-1D-5 and Provide the Drug Free Workplace Conformance Affidavit.

Interested sub-contractors and material suppliers are also encouraged to attend. Title V of the Federal Clean Air Act and the state Air Pollution Control Act requires that all major sources and certain minor sources have a permit to operate which states all requirements (e.g. emission limitations, monitoring requirements, etc.) established by regulations promulgated under the aforementioned programs. Notice of Consulting Services

Notice is hereby given by the West Virginia Department of Transportation, Division of Highways, that engineering consulting services will be utilized for the following project:

State Project S335-470-0.13 00, I-470 Br Appr, located in Ohio County, West Virginia. This project shall consist of the preparation of a rehabilitation recommendation report and contract plans and any other related work that may be required for the renovation of the approach spans of a bridge carrying Interstate 470 over the Ohio River and various routes/streets in the City of Wheeling. The approach spans of the existing bridge are 3652 feet total length by 83 feet wide and begin at a point located 0.11 miles east of the Ohio state line.

Method of payment shall be either Lump Sum or Cost Plus Fixed Fee.

A single assignment will be made for this project.

Firms interested in being considered for this project must submit a "Letter of Qualification" and one unpriced prospectus to Mr. Michael D. Lilly, P. E., Section Head, Technical Section, Engineering Division, Division of Highways, 1334 Smith Street, Charleston, West Virginia 25301 or
preferably by email to doh.consultantservices@wv.gov prior to 4:00 p.m. on September 5, 2017.

As a minimum, the prospectus shall include the following evaluation information factors:

1. Professional qualifications necessary for consideration and satisfactory performance of the required work and as a minimum shall have a professional engineer licensed by the State of West Virginia. That person shall be located within the office where the work is to be performed, and shall demonstrate sufficient past experience performed for the State of West Virginia, Department of Highways related to design and plan development to be provided. This individual shall be the person-in-charge overseeing the work and must be readily accessible to the Department, preferably located in-state.

2. Consideration shall be given to specialized experience and technical competence. Specialized experience shall focus on the qualifications of the staff working on the project with emphasis placed on individual specialized expertise required for the project. As a minimum, the firm shall provide a Résumé of those individuals who will be committed to the needs of the project. Strong considerations will be based on the professional and non-professional staff specialized experience and technical competence stationed within the office where the work is to be performed.

3. Capacity consideration shall be made on the firm's ability to accomplish the work within the Department's required schedule time frame; personnel dedicated to perform such work.

4. Past performance on contracts with Government agencies and private industry in terms of cost control, quality of work, and compliance with performance schedules.

5. Location shall be based on the geographic location of the Consultant's office relative to the project site along with past experience and knowledge of the area where the project site is located with the significant importance being given to accessibility of the office location relative to the Department.

In addition to the above evaluation factors, the prospectus shall include, as a minimum, the following items:

1. A completed copy of the Division's Consultant Confidential Qualification Questionnaire dated January 1, 2017 or later, if not already on file. It must specifically indicate the staff levels by classification located in-state vs. out-of-state.

2. Location of office or office(s) in which the work, or part of the work, will be performed.

3. Identification of subconsultants by name as to the type of work anticipated to be subcontracted or performed, if proposed as part of the design team.

4. Indication of whether a cost accounting system has been maintained and is in effect such that it is capable of segregating and identifying accumulating costs for each job that is performed under cost type projects.

5. Completed copies of the Division's "Consultant Short List Selection Criteria Technical Evaluation" form limited to a single page of data. One loose leaf copy of form is to accompany the bound unpriced prospectus. Cross referencing on this form to other parts of the prospectus is not acceptable.

6. A copy of a valid "Certificate of Authorization" to offer Engineering, Surveying, or other related services within the state, issued by the appropriate West Virginia Board.

A
single "Letter of Qualification" and one unpriced prospectus are required and must contain all of the above information required to be considered. Failure to provide the required information and/or insufficient information will cause disqualification and the prospectus will be returned. 3. Capacity consideration shall be made on the firm's ability to accomplish the work within the Department's required schedule time frame; personnel dedicated to perform such work.

MEMORANDUM OF AGREEMENT FOR THE
DEMOLITION OF CLENDENIN ELEMENTARY SCHOOL, 503 MAYWOOD AVENUE EAST, CLENDENIN, KANAWHA COUNTY, WEST VIRGINIA, UNDER THE PUBLIC ASSISTANCE PROGRAM - SEEKING PUBLIC COMMENT
Severe storms and flooding that occurred in June 2016, resulted in the federally declared disaster DR-4273-WV (disaster). The Federal Emergency Management Agency (FEMA) is issuing this public notice as a part of its responsibilities under 36 CFR Part 800, the regulations implementing Section 106 of the National Historic Preservation Act, as amended, and Section I.D (Public Participation) of the Programmatic Agreement Among the West Virginia State Historic Preservation Officer, the West Virginia Division of Homeland Security and Emergency Management, the Catawba Indian Nation, and the Seneca Nation of Indians of New York (Statewide PA). This notice applies to activities carried out by FEMA's Public Assistance (PA) program implemented under the authority of the Robert T. Stafford Disaster Relief and Emergency Assistance Act, 42 U.S.C. §§ 5152-5207.
FEMA is providing funding to the West Virginia School Building Authority (SBA) for the demolition of Clendenin Elementary School, which was substantially damaged during the disaster and must be relocated outside of the floodplain. The regulations at 36 CFR Part 800 and the stipulations of the Statewide PA require FEMA to consider the effects of its funding actions on historic properties. A "historic property" is a prehistoric or historic district, site, building, structure, or object included in or eligible for inclusion in the National Register of Historic Places (NRHP). The Section 106 compliance process seeks to accommodate historic preservation concerns with the needs of Federal undertakings through consultation among the Federal agency and other parties with an interest in the effects of the undertaking on historic properties. Section 106 review encourages, but does not mandate preservation of the historic property, but does ensure that preservation values are factored into Federal agency planning and decisions. Under Section 106, FEMA must identify if properties are listed in or eligible for listing in the NRHP; assess the effects the proposed undertaking will have on identified historic properties; and seek ways to avoid, minimize, or mitigate any adverse effect to the historic properties. FEMA evaluated Clendenin Elementary School for eligibility for listing in the NRHP, and determined that the building is eligible for listing under Criterion C (Architecture) of the NRHP Criteria for Evaluation as a significant example of the Art Deco style as applied to a public school building, and that the proposed demolition constitutes an adverse effect on the historic property. FEMA consulted with the West Virginia State Historic Preservation Officer (SHPO), and the SHPO concurred with this determination of eligibility and finding of adverse effect, and with FEMA's intent to negotiate a Memorandum of Agreement (MOA). This public meeting seeks input on the proposed measures identified by the consulting parties to compensate for the loss of the historic property as required under Section 106.
This meeting will not address issues related to relocation and construction of the replacement facility.
As required under §800.2(c) and Section I.D.2 of the Statewide PA, FEMA, in consultation with the SHPO, identified those parties with a demonstrated interest in the undertaking, and invited those parties to participate in the negotiation of the MOA. As SBA has determined that they will not retain the historic property, Section 106 consultation focused on the identification of treatment measures that will mitigate the loss of Clendenin Elementary School and benefit the wider Clendenin community. These measures are documented in the Draft MOA, which clearly outlines those measures that will be implemented to offset the loss of the historic property resulting from the FEMA-funded undertaking. They include: (1)
Walking Path and Interpretive Signs. SBA will construct a 1,580-linear foot walking trail around the perimeter of the Clendenin Elementary School parcel and will install four (4) interpretive signs that describe specific events in the history of Clendenin. SBA will also incorporate the "Big Sandy High School" surround from the main entrance of Clendenin Elementary School into a memorial marker for Clendenin Elementary School, and will also construct a flagpole and planter with up-lighting on the Clendenin Elementary School site. 25045 - A New Clendenin, Inc. (New Clendenin), will implement the application of a mural that will cover the west wall of the old bus garage that is located on the east side of the Clendenin Elementary School site. This mural will reflect, but not duplicate, the content of the interpretive signs, but may include other cultural references appropriate for the Clendenin community. FEMA shall provide funds to the SBA and New Clendenin through the West Virginia Division of Homeland Security and Emergency Management for the implementation of these treatment measures. Kanawha County Board of Education (Kanawha County BOE) will retain ownership of the Clendenin Elementary School site until all treatment measures to be executed by SBA are complete. All measures shall be completed within twenty-four (24) months from the date of execution of this MOA. Kanawha County BOE will retain ownership and will maintain the park throughout the twenty-four (24) month period that represents the term of the MOA. (2) Recordation: FEMA will also complete photographic and written documentation of Clendenin Elementary School, which will be submitted to the SHPO and will be preserved in the West Virginia State Archives.
The public meeting to seek public input on the Draft MOA will be held at the Clendenin Community Center, 101 First Street, Clendenin, WV 25045, August 17, 2017, 6:30 - 9:00 PM. The Draft MOA will be available for review at the Clendenin Town Hall, 103 First Street, Clendenin, West Virginia 25045, during the public comment period from August 10 to August 24, 2017. Comments may be submitted via e-mail at fema-r3-ehp-publiccomment@fema.dhs.gov or you may submit comments to Regional Environmental Officer, FEMA, One Independence Mall, 6th floor, Philadelphia, PA 19106. Comments may also be presented orally or submitted in writing at the public meeting.

Contracts are to be awarded on a fixed fee basis.

Interviews with each firm selected will be conducted, which may include discussions regarding anticipated concepts and proposed methods of approach. The Region 4 Planning and Development Council will rank, in order of preference, these three professional firms deemed to be the most highly qualified to perform the services required, and will commence scope of services and price negotiations with the highest qualified professional firm for engineering services.

Should the Region 4 Planning and Development Council be unable to negotiate a satisfactory contract with the professional firm considered to be the most qualified, at a fee determined to be fair and reasonable, price negotiations with the firm of second choice will commence. Failing accord with the second most qualified professional firm, the committee will undertake price negotiations with the third most qualified professional firm. Should the Region 4 Planning and Development Council be unable to negotiate a satisfactory contract with any of the selected professional firms, it will select additional professional firms in order of their competence and qualifications and it will continue negotiations in accordance with these procedures until an agreement is reached.

This contract will be awarded to the responsible offeror whose proposal is within the competitive range and determined to be the most advantageous to the Region 4 Planning and Development Council, price and other factors considered.

West Virginia Code 21-11-2 requires all Bidders desiring to perform contractual work in West Virginia must be duly licensed. All Bidders must also be registered with the local jurisdiction and will be required to pay applicable B&O taxes.

Design and control of the project must be in conformance with the guidelines of the Recreational Trails Program and all applicable State and Federal Regulations. All work will be in accordance with all pertaining Federal, State and Municipal laws, rules, and regulations.
The successful Bidder will be required to furnish a satisfactory Performance Bond and Labor and Material Payment Bond, both in the amount of at least one hundred percent (100%) of the Contract Price.
Bidders must be properly licensed under the laws governing their respective trades and be able to obtain insurance and bonds required for the Work.

Notice is hereby given that Revelation Energy, LLC 1051 Main Street, Milton, WV 25541, phone number (304) 390-5958, surface mine permit number S-3004-04 situated in Louden District of Kanawha County, approximately 1.5 miles west of Marmet, WV will be conducting blasting activities in accordance with all State and Federal Laws and as approved by the Department of Environmental Protection.

Blasting activities will occur Monday through Saturday from "
sunrise to sunset" No blasting shall be conducted on Sunday. Blasting is to commence on August 16, 2017 and continue through August 15, 2018.

Ten minutes prior to and immediately after each blast, all access to the specific area will be safeguarded from unauthorized entry. The warning signal prior to each blast shall be from an air horn audible to at least one half mile from the blast. The warning will be given three (3) minutes prior to detonation and will consist of three (3) short blasts of five (5)seconds duration with five (5) seconds between each blast. The allclear signal shall be one (1) long blast from an air horn of twenty (20) seconds duration.

Blasting shall be conducted in such a way so as to prevent adverse impacts to the public or the environment.
Blasting activities will not be conducted at times other than those announced in the blasting schedule except in the event of an emergency situation where rain, lightning, or other atmospheric conditions, or operator or public safety requires unscheduled detonations.

ASSISTANCE CONSULTANT

The TOWN OF CLENDENIN has recently been devastated by the effects of severe storms and flooding.(FEMA-4180-DR-NY). We are in the process of planning and executing a massive recovery program. To that end, the TOWN OF CLENDENIN seeks a professional consultant or consulting firm to provide expertise to augment our capabilities to recover the maximum financial recovery from FEMA and New York State. The ideal Consultant shall possess demonstrated experience in programmatic disaster recovery and must have intimate knowledge and expertise in the operations of the Federal Emergency Management Agency (FEMA) Public Assistance Program including hazard mitigation.

SCOPE OF WORK:
The selected Consultant shall assist the Town with the following duties and others as mutually agreed upon:
• Provide technical advisory services related to
recovery from disasters.
• Develop and implement strategies designated to
maximize federal and state assistance.
• Provide expert programmatic and policy advice on
federal disaster relief programs.
• Provide support for strategic planning and
coordination of all recovery efforts.
• Review contracts and purchasing documentation to
ensure cost recovery.
• Represent TOWN OF CLENDENIN and attend
meetings with FEMA/NYSOEM on behalf of the
Town.
• Damage Site Assessment & Project Worksheet
Formulation.
• Identify Potential Improvement & Maximize Public
Assistance 406-Mitigation Funding.
• Meet with Town Department Heads and Collect/
Compile Cost Documentation for PW's.
• Document permit requirements; Maintain Code
Compliance ( building, floodplain, etc.).
• Provide assistance and oversight to Departments
that have difficulty with claims.
• Interaction with the Town's Public Adjusting Firm.
• Process the Town's Progress Payment Requests.
• Work with Officials to resolve disputes with FEMA
and/or NYSOEM, including Preparation of Appeals.
• Provide Grant Close-Out Services to ensure funding
is retained.

SPECIAL CONDITIONS:
1. The selection of a consultant will not guarantee any
minimum amount of services under the contract.
2. Where applicable, the TOWN OF CLENDENIN will
perform administrative and document processing
tasks to maximize return.
3. The TOWN OF CLENDENIN reserves the right to
reject any or all proposals; to negotiate any
elements of a proposal; to conduct interviews at its

Envelope No. 1 will be opened first and the Bid Opening Requirement items checked for compliance as outlined on the Bid Opening Checklist on page BOR - 1 of these bidding documents. If such documents are found to be in order, Envelope No. 2 "Bid Proposal", will then be opened and will be publicly read aloud. If the documents required to be contained in Envelope No. 1 are not in order, Envelope No. 2 "Bid Proposal" will not be opened and the Bid will be considered non-responsive and will be returned to the Bidder.

A Bidder may not withdraw his bid for a period of sixty (60) days after the date set for the opening of bids.

Bids shall be accompanied by a certified check or bid bond payable to West Ridge, Inc., in an amount equal to ten percent (10%) of the base bids.
Contractor is required to provide the Drug Free Workplace Certification in accordance with WV Code 21-1D-5.

All Bidders are required to have a West Virginia Contractor's License per Section §21-11-11 of the West Virginia Code.

Bids received after the scheduled closing time for the reception of bids will be returned unopened to the respective Bidder(s).

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
