Each bid shall be accompanied by a bid bond, made payable to the Owner, in the amount of five percent (5%) of the base bid, in accordance with the Instructions to Bidders.
The Owner reserves the right to reject any or all bids, the right to waive minor informalities and procedures in bidding, and the right to withhold final award of contract for 60 days after opening bids.

The bidder to whom the contract is awarded shall execute and deliver to the Owner within 10 days after the award, and before signing the contract, a Performance Bond and Payment Bond utilizing the bond forms bound in the Project Manual each in a penal sum equal to at least the contract sum and the cost of such bonds shall be included in the bid.

This is a Single Prime Contractor project. OWPR, Inc., the Architect/Engineer, will conduct a MANDATORY PRE-BID CONFERENCE on Thursday, June 22, 2017 at 2:00 PM at East Hardy Early Middle School, 238 Cougar Drive, Baker, West Virginia 26801; all interested Prime Contractor bidders are REQUIRED to attend. Interested sub-contractors and material suppliers are also encouraged to attend. The purpose of the pre-bid conference is to familiarize the Bidders with bidding requirements and to answer questions regarding the Bidding Documents.

All bids must be accompanied by a Bid Bond, executed by the Bidder and an acceptable Surety, in an amount equal to 5% of the bid. The successful bidder will be required to furnish and pay for a 100% Performance and Material Payment Bond in the amount of the bid (including all add alternates), as described in the Instructions to Bidders. Each bidder shall ensure that all employees and applicants for employment are not discriminated against because of race, creed, color, sex, or national origin.

No bidder may withdraw his bid within thirty (30) days after the bid opening. The Owner reserves the right to conduct such investigation as necessary to determine the responsibility of a bidder, and to the extent permitted by state law; Hardy County Schools reserves the right to reject any and all bids, and to make selections from the bids that are solely in the best interest of Hardy County Schools.

All proposals must include a statement of the proposed use of the Property, the timeframe for commencement and completion of the Project. All proposals shall include a statement of qualifications and background of respondent demonstrating the experience and capabilities of respondent and suitability for this Project. All proposals must identify the state of formation or organization of the respondent and identify the principal owners/members thereof. Proposals must include the purchase price or lease terms offered for the Property, the Project development costs and explanation of how the Project will be financed. All proposals will be required to comply with all requirements of applicable Federal, State and local laws and regulations.

All proposals must include a completed Offer (the form of which may be obtained by contacting the Authority) signed by developer. The signed Offer must be accompanied by either a purchase deposit check in the amount of ten percent (10%) of the proposed price for the Property if the Property is to be purchased or a lease deposit check in the amount of one year's rent under the proposed lease if the Property is to be leased. Deposit checks will be returned to all respondents not selected by the Authority as a Redeveloper for any Property after the conclusion of the selection process.

All proposals are subject to review and approval by the Authority. Selected proposals judged by the Authority as most qualified might be asked to make a presentation to the Authority at its next monthly board meeting and may be requested to submit supplemental documentation for the proposal. The criteria upon which the redeveloper is selected includes without limitation factors such as the proposed use of the Property, the Project design, the experience, qualifications, reputation, and organization of the respondent, feasibility and sources of financing and the cost of Project, the timeline for commencement and completion of Project, adherence to controls set forth in the applicable Urban Renewal Plan, and the benefits to the community.

The Authority will accept and evaluate proposals for the redevelopment and rehabilitation of any of the Properties on or before 4:00 p.m. on June 28, 2018. Submittals must be complete and must be delivered to the Charleston Urban Renewal Authority, Suite 244, Morrison Building, 815 Quarrier Street, Charleston, West Virginia 25301. It is the responsibility of the respondent to ensure the Authority's timely receipt of the proposal.

Notice of Consulting Services

Notice is hereby given by the West Virginia Department of Transportation, Division of Highways, that engineering consulting services will be utilized for the following project:

State Project U399-TIP-17. 00, TIP 2017, located statewide. This project shall consist of Quality Assurance Management (QAM) services for approximately 55 bridge replacements/renovations/rehabilitations as part of the Transportation Improvement Program for 2017. This program will be divided into groups of 10 to 15 bridge projects that will be assigned to 4 (four) individual consulting firms underneath the referenced State Project Number. These QAM services shall consist of determining project specific scope of work and preparing Request for Proposal (RFP) documents, developing final project design criteria, developing right-of-way and utility criteria, developing environmental clearance criteria and/or obtaining environmental clearance, determining any special permit needs, evaluating the need for special details/provisions, providing assistance in addressing pre-bid inquiries from Design-Build teams, and providing plan review and other related work as required. In addition, the QAM shall be responsible for locating any existing Right-of-Way plans/information along with existing bridge plans and/or inspection reports.

Method of payment shall be either Lump Sum or Cost Plus Fixed Fee.

Multiple assignments will be made for this project.

Firms interested in being considered for this project must submit a "Letter of Qualification" and one unpriced prospectus to Mr. Michael D. Lilly, P. E., Section Head, Technical Section, Engineering Division, Division of Highways, 1334 Smith Street, Charleston, West Virginia 25301 or
preferably by email to doh.consultantservices@wv.gov prior to 4:00 p.m. on July 10, 2017.

As a minimum, the prospectus shall include the following evaluation information factors:

1. Professional qualifications necessary for consideration and satisfactory performance of the required work and as a minimum shall have a professional engineer licensed by the State of West Virginia. That person shall be located within the office where the work is to be performed, and shall demonstrate sufficient past experience performed for the State of West Virginia, Department of Highways related to design and plan development to be provided. This individual shall be the person-in-charge overseeing the work and must be readily accessible to the Department, preferably located in-state.
2. Consideration shall be given to specialized experience and technical competence. Specialized experience shall focus on the qualifications of the staff working on the project with emphasis placed on individual specialized expertise required for the project. As a minimum, the firm shall provide a Résumé of those individuals who will be committed to the needs of the project. Strong considerations will be based on the professional and non-professional staff specialized experience and technical competence stationed within the office where the work is to be performed.
3. Capacity consideration shall be made on the firm's ability to accomplish the work within the Department's required schedule time frame; personnel dedicated to perform such work.
4. Past performance on contracts with Government agencies and private industry in terms of cost control, quality of work, and compliance with performance schedules.
5. Location shall be based on the geographic location of the Consultant's office relative to the project site along with past experience and knowledge of the area where the project site is located with the significant importance being given to accessibility of the office location relative to the Department.

In addition to the above evaluation factors, the prospectus shall include, as a minimum, the following items:

1. A completed copy of the Division's Consultant Confidential Qualification Questionnaire dated January 1, 2017 or later, if not already on file. It must specifically indicate the staff levels by classification located in-state vs. out-of-state.
2. Location of office or office(s) in which the work, or part of the work, will be performed.
3. Identification of subconsultants by name as to the type of work anticipated to be subcontracted or performed, if proposed as part of the design team.
4. Indication of whether a cost accounting system has been maintained and is in effect such that it is capable of segregating and identifying accumulating costs for each job that is performed under cost type projects.
5. Completed copies of the Division's "Consultant Short List Selection Criteria Technical Evaluation" form
limited to a single page of data. One loose leaf copy of form is to accompany the bound unpriced prospectus. Cross referencing on this form to other parts of the prospectus is not acceptable.
6. A copy of a valid "Certificate of Authorization" to offer Engineering, Surveying, or other related services within the state, issued by the appropriate West Virginia Board.

A
single "Letter of Qualification" and one unpriced prospectus are required and must contain all of the above information required to be considered. Failure to provide the required information and/or insufficient information will cause disqualification and the prospectus will be returned. All evaluation factors as noted herein before will be given equal consideration in the selection process, unless a project specific weighting of the evaluation factors is shown in the Notice for Consulting Services.
Prior to entering into any contract negotiations, the selected firm and any subconsultants shall submit a current audited overhead rate computation performed by a State or Federal government agency or independent CPA firm. The submitted overhead audit shall contain a detailed exhibit of the computations with all applicable eliminations and references. The audit shall be done in accordance with
Government Auditing Standards issued by the Comptroller General of the United States and all eliminations required by the Federal Acquisition Regulations will be made. The submitted certified audited overhead (Indirect Cost Rate) report shall include the certification, certifying that the allowability of costs used to establish the final indirect cost rate are in accordance with the FAR cost principles, or a verification indicating this certification was previously submitted and accepted by the cognizant agency. This requirement will be waived for the selected firm or any subconsultant when its portion of the fee for the project is less than Two Hundred Fifty Thousand Dollars ($250,000.00). In such instances, a company computed overhead rate may be utilized.

It is the policy of the West Virginia Department of Transportation, Division of Highways, that Disadvantaged and Women-owned Business Enterprises shall have the maximum opportunity to participate in the performance of contracts financed in whole or in part with Federal funds.

State Project S319-340-15.78 00, US 340 Rock Slide Investigation, located in Jefferson County, West Virginia. This project shall consist of the development of National Environmental Policy Act (NEPA) documentation for the regrading/stabilization of an existing rock cut slope. The project is located along United States Route (US) 340 approximately 0.25 mile west of the Virginia state line. The work shall comply with West Virginia State environmental regulations and federal regulations including, but not limited to, Federal Highway Administration Guidelines, Clean Water Act, National Historic Preservation Act, Section 4(f), and Endangered Species Act.

Method of payment shall either be Lump Sum or Cost Plus Fixed Fee.

A single assignment will be made for this project.

Firms interested in being considered for this project must submit a "Letter of Qualification" and one unpriced prospectus to Mr. Michael D. Lilly, P. E., Section Head, Technical Section, Engineering Division, Division of Highways, 1334 Smith Street, Charleston, West Virginia 25301 or
preferably by email to doh.consultantservices@wv.gov prior to 4:00 p.m. on July 10, 2017.

As a minimum, the prospectus shall include the following evaluation information factors:

1. Professional qualifications necessary for consideration and satisfactory performance of the required work shall be provided for that person in-charge of overseeing the work. That person shall be located within the office where the work is to be performed, and shall demonstrate sufficient past experience performed for the State of West Virginia, Department of Highways related to design and plan development to be provided. This individual shall be readily accessible to the Department, preferably located in-state.
2. Consideration shall be given to specialized experience and technical competence. Specialized experience shall focus on the qualifications of the staff working on the project with emphasis placed on individual specialized expertise required for the project. As a minimum, the firm shall provide a Résumé of those individuals who will be committed to the needs of the project. Strong considerations will be based on the professional and non-professional staff specialized experience and technical competence stationed within the office where the work is to be performed.
3. Capacity consideration shall be made on the firm's ability to accomplish the work within the Department's required schedule time frame; personnel dedicated to perform such work.
4. Past performance on contracts with Government agencies and private industry in terms of cost control, quality of work, and compliance with performance schedules.
5. Location shall be based on the geographic location of the Consultant's office relative to the project site along with past experience and knowledge of the area where the project site is located with the significant importance being given to accessibility of the office location relative to the Department.

In addition to the above evaluation factors, the prospectus shall include, as a minimum, the following items:
1. A completed copy of the Division's Consultant Confidential Qualification Questionnaire dated January 1, 2017 or later, if not already on file. It must specifically indicate the staff levels by classification located in-state vs. out-of-state.
2. Location of office or office(s) in which the work, or part of the work, will be performed.
3. Identification of subconsultants by name as to the type of work anticipated to be subcontracted or performed, if proposed as part of the design team.
4. Indication of whether a cost accounting system has been maintained and is in effect such that it is capable of segregating and identifying accumulating costs for each job that is performed under cost type projects.
5. Completed copies of the Division's "Consultant Short List Selection Criteria Technical Evaluation" form
limited to a single page of data. One loose leaf copy of form is to accompany the bound unpriced prospectus. Cross referencing on this form to other parts of the prospectus is not acceptable.

A
single "Letter of Qualification" and one unpriced prospectus are required and must contain all of the above information required to be considered. Failure to provide the required information and/or insufficient information will cause disqualification and the prospectus will be returned. All evaluation factors as noted herein before will be given equal consideration in the selection process, unless a project specific weighting of the evaluation factors is shown in the Notice for Consulting Services.

Prior to entering into any contract negotiations, the selected firm and any subconsultants shall submit a current audited overhead rate computation performed by a State or Federal government agency or independent CPA firm. The submitted overhead audit shall contain a detailed exhibit of the computations with all applicable eliminations and references. The audit shall be done in accordance with Government Auditing Standards issued by the Comptroller General of the United States and all eliminations required by the Federal Acquisition Regulations will be made. The submitted certified audited overhead (Indirect Cost Rate) report shall include the certification, certifying that the allowability of costs used to establish the final indirect cost rate are in accordance with the FAR cost principles, or a verification indicating this certification was previously submitted and accepted by the cognizant agency. This requirement will be waived for the selected firm or any subconsultant when its portion of the fee for the project is less than Two Hundred Fifty Thousand Dollars ($250,000.00). In such instances, a company computed overhead rate may be utilized.

It is the policy of the West Virginia Department of Transportation, Division of Highways, that Disadvantaged and Women-owned Business Enterprises shall have the maximum opportunity to participate in the performance of contracts financed in whole or in part with Federal funds.

FOR ARCHITECT/ENGINEERING
SERVICES

I. PROJECT
BACKGROUND:

The Logan County Commission is currently accepting Statements of Qualifications from qualified architect/engineering firms detailing the firm's qualifications, technical expertise, management and staffing capabilities, references, and related prior experience. Professional services will include, but are not limited to, preliminary engineering, design - and construction - related services, preparation of bidding and contract documents, participation in the evaluation of bids received, and monitoring and inspection of construction activities to ensure compliance with plans and specifications associated with each project and grant guidelines. Procurement of services will be in accordance with Chapter 5G of the WV State Code and 2 CFR 1.100. of the Office of Management and Budget (OMB).

This project stems from the monumental floods that ravaged the central region of West Virginia in June 2016. The Logan County Commission will be submitting Hazard Mitigation Grant Program (HMGP) applications through the Federal Emergency Management Agency (FEMA) for the elevation and reconstruction of homes above the current base flood elevation. Each home will be an independent project and multiple structures will be submitted in each application. Any municipality in Logan County applying for funds through DR-4273-WV will also be eligible to use the services procured through this request and at the same rate as the Logan County Commission.

II. SCOPE OF
SERVICE

There are two different elements within the scope of work. The initial project will consist of the application process. If approved, the project will then involve implementation of the grant through the elevation or reconstruction of homes in the affected area. The scope of the project will consist of the following:

A. Grant Application

1. Preparation of a preliminary design and estimates to establish suitable and economical forms of construction.

2. Preparation of preliminary cost estimates for grant application budget.

3. Preparation of drawings and other assistance required for the grant application.

B. Grant
Implementation

1. Preparation of detailed drawings, specifications and related contract documents necessary to prepare project for bid solicitation.

2. Assistance in obtaining and analyzing bids.

3. Recommendations for award and assistance in preparation of formal contract.

4. Interpretation of contract plans, specifications and special instructions to contractor.

5. Checking and approvals of drawings.

6. Necessary periodic inspections of the job site.

7. Reviewing reports of materials and equipment.

8. Making final inspection and reports on completed project.

All projects will be funded through FEMA's Hazard Mitigation Grant Program (HMGP). The funds will be administered through the State of West Virginia's Office of Homeland Security and its Hazard Mitigation Division. The overall scope of the project will consist specifically of "Mitigation Reconstruction" projects and elevation of homes. Please reference FEMA'S "FY15 Hazard Mitigation Assistance Guidance" and "FY15 Hazard Mitigation Assistance Guidance Addendum" for more information regarding the programs. All homes will be built according to FEMA'S standards, those outlined in the Logan County Floodplain Ordinance or any municipal regulations in that jurisdiction.

The architectural and engineering firm will furnish necessary services to design and administer construction of this project. The actual construction work, procurement of equipment, materials and supplies, together with all other work and labor necessary for the construction of this project will be performed by general contractors and/or subcontractors through separate procurement processes. The method of awarding the contracts and the work contained therein shall be the sole decision of the Logan County Commission or municipality.

III. SUBMISSION
REQUIREMENTS

Qualified firms/candidates interested in being considered for this project must submit five (5) copies each of 1) Letter of Interest, 2) Statement of Qualifications, 3) technical experience and previous professional experience, 4) expertise of staff, 5) persons who will be in charge of the project, 6) previous experience with the Logan County Commission, and 7) references.

Submit the requested information no later than 2:00 p.m. on Monday, July 10, 2017, to receive consideration.

IV. EVALUATION OF
RESPONSES

The object of this competitive process is to objectively select the architect/engineering firm that will provide the highest quality of service at a realistic fee. Accordingly, technical qualifications and experience will be weighed heavily. Based on evaluation of the proposals, three firms will be invited to submit additional information and be interviewed. The candidate judged most qualified will be asked to prepare a proposal, including fixed fees for said services. The Commission reserves the right to reject any and all proposals. The County will select a firm that will then be eligible to work with all eligible municipalities in Logan County.

Attention is directed to the fact that the proposed project will be undertaken through Federal and/or State agencies and that all work will be performed in accordance with the regulations issued by these agencies and the State of West Virginia pertaining hereto. The selected firm will be required to comply with Title VI of the Civil Rights Act of 1964, Executive Order 11246, Conflict of Interest Statement and Access to Records provision.

Additional Federal and State funding requirements may also apply. The Commission will afford full opportunity for minority and women-owned business enterprises to submit a show of interest in response to the invitation and will not discriminate against any firm or individual on the grounds of race, creed, color, sex, age, handicap status or national origin in the contract award.

The firm agrees to make "good-faith efforts" when subcontracting any portion of the total value of the contract to minority/women-owned businesses. This shall be done in compliance with the six (6) affirmative steps, as outlined in 40 CFR 33.240. Failure to demonstrate positive efforts to do so may lead to a disallowance of cause. For the purpose of this program, the term "subcontractor" includes all construction, modification, and service work contracted for/by the firm in the execution of the work under this contract.

V. EVALUATION OF
RESPONSES

Each firm's qualifications will be based upon the following criteria:

1. Firm and Individual Qualifications:
a. Firm's number of years in business.
b. Firm's background and experience on similar projects.
c. Experience of firm's current personnel on similar projects.

2. Proximity to Project Site.

3. Capacity to Perform Work:
a. Ability to meet proposed schedule.
b. Firm's equipment & facilities.

4. References:
a. Quality of design.
b. Technical innovation.
c. Meeting schedules &
deadlines.
d. Controlling costs/
adhering to budget.
e. Communications/
cooperation.

5. Past Performance with the Logan County Commission.

*The weight or value of each criteria will be established by the committee appointed to review qualifications.

VI. INSURANCE
REQUIREMENTS

Before starting and until termination of work, the selected firm shall procure and maintain insurance of the types and to the limits specified.

Insurance shall be issued by an insurer whose business reputation, financial stability and claims payment reputation is satisfactory to the county/local municipality. Unless otherwise agreed, the amounts, form and type of insurance shall conform to the following minimum requirements:

A. Workers' Compensation

The firm shall purchase and maintain Worker's Compensation Insurance Coverage for all Workers' Compensation obligations required by the State of West Virginia.

B. Commercial General & Professional Liability Coverage

The selected firm shall purchase coverage on forms no more restrictive than the latest editions of the Commercial General Liability policies. The Commission or municipality shall be an Additional Insured and such coverage shall be at least as broad as that provided to the Named Insured under the policy for the terms and conditions of the contract. The Commission or municipality shall not be considered liable for premium payment, entitled to any premium return or dividend and shall not be considered a member of any mutual or reciprocal company. Minimum limits of $1,000,000 per occurrence, and per accident, combined single limit for liability must be provided, with umbrella insurance coverage making up any difference between the policy limits of underlying policies coverage and the total amount of coverage required. If the required limits of liability afforded should become impaired by reason of any claim, then the firm agrees to have such limits of $1,000,000 per occurrence, reinstated under the policy.

Commercial General Liability coverage must be provided, including bodily injury and property damage liability for premises, operations, products and completed operations, contractual liability, and independent contractors. Broad Form Commercial General Liability coverage or its equivalent shall provide at least, broad form contractual liability applicable to this specific contract, personal injury liability and broad form property damage liability. The coverage shall be written on occurrence-type basis.

Professional Liability insurance coverage must be provided to afford protection for errors and omissions arising out of services provided under, or associated with, the contract.

VII. CERTIFICATE OF
INSURANCE

Required insurance shall be documented in the Certificates of Insurance that provide that the Logan County Commission or municipality shall be notified at least thirty (30) days in advance of cancellation, nonrenewal or adverse change or restriction in coverage. The Logan County Commission or municipality shall be named on each Certificate as an Additional Insured, and this contract shall be listed. If required by the county/municipality, the architect/engineer shall furnish copies of the insurance policies, forms, endorsements, jackets and other items forming a part of, or relating to, such policies. Certificates shall be on the "Certificate of Insurance" form.

Any wording in a Certificate which would make notification of cancellation, adverse change or restriction in coverage to the county/municipality an option shall be deleted or crossed out by the insurance carrier or the insurance carrier's agent or employee. The architect/engineer shall replace any canceled, adversely changed, restricted or nonrenewed policies with new policies acceptable to the local jurisdiction and shall filed with the Certificates of Insurance under the new policies prior to the effective date of such cancellation, adverse change or restriction.

If any policy is not timely replaced, in a manner acceptable to the jurisdiction the architect/engineer shall, upon instructions of the jurisdiction, cease all operations under the contract until directed by the jurisdiction, in writing, to resume operations.

NOTICE OF REQUEST
FOR CONSTRUCTION BIDS

The Monroe Health Center, (hereinafter called "OWNER") invites qualified contractors to submit sealed bids for Additions and Alterations to their Peterstown, West Virginia Clinic. Sealed bids will be received at the offices of the Monroe Health Center, located at 200 Health Center Drive, Union, West Virginia 24983, until 2:00 p.m., local prevailing time, on Thursday, July 13, 2017, at which time the bids will be publicly opened and read aloud.

The work of this project consists of the following Lump Sum contract:

A new 1,300 square foot addition and interior renovations to the existing clinic at Peterstown.

Contract Documents are available for inspection during regular working hours at the office of the OWNER; office of the Architect - J. Dan Snead & Associates, Inc., 101 North Kanawha Street, Suite 203, Beckley, West Virginia, 25801 (telephone: 304/252-6630); and The Contractor's Association of West Virginia, 2114 Kanawha Blvd., East, Charleston, West Virginia 25311 (telephone: 304-342-1166).

Contract Documents may be obtained at the office of the Architect upon written request and non-refundable payment of One Hundred Dollars ($100.00) for each set. Payment shall be in the form of certified check, cashiers check or money order made payable to the Architect.

A mandatory pre-bid meeting will be held at the Monroe Health Center, Peterstown, West Virginia on Wednesday, June 28, 2017 at 10:00 a.m.

Bids shall be submitted on the required Bid Form. All blank spaces on the bid forms must be filled in and the Bid Form must be fully completed and executed when submitted. An acceptable Bid Bond, made payable to the OWNER, in the amount of five percent (5%) of the total bid, must accompany each Bid. West Virginia State Contractor's License will be required of all bidders.

The parties to whom Contracts are awarded will be required to execute the Agreement and obtain the required Performance Bonds and Labor and Materials Payment Bonds within ten (10) calendar days from the date of Notice of Award.

The OWNER reserves the right to waive any informalities or to reject any and all Bids in whole or in part. Any Bid may be withdrawn prior to the above scheduled time for the opening of Bids or authorized postponement thereof. Any Bid received after the time and date specified will not be considered. No bidder may withdraw a Bid within sixty (60) days after the actual date of the opening thereof. Should there be reasons why the Contract cannot be awarded within the specified period, the time may be extended by mutual agreement between the OWNER and the Bidder.
