Under authority of a certain Deed of Trust dated January 20, 2016, from Kathryn Tyson to Anthony Marks and Ronald D. Beane, Trustees, securing First Bank of Charleston, Inc., in the amount of $99,627.48, of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia in Trust Deed Book 4149, at page 137, default having been made in the payment of the obligation secured by said Deed of Trust, and sale having been requested in writing by the holder of the indebtedness secured, the undersigned, Raymond G. Dodson, Substitute Trustee, by virtue of Notice of Substitution of Trustee dated June 12, 2017, of record in the aforesaid Clerk's Office in Book 4246, at page 290,will offer for sale at the front door of the Kanawha County Courthouse in Charleston, West Virginia, on the 7th of July, 2017 at 10:00 o'clock, the certain real estate conveyed in said Deed of Trust, as described as follows:
All those certain lots, tracts or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of Charleston, Charleston West District, Kanawha County, West Virginia, and being more particularly bounded and described as follows:
PARCEL 1: Tax Map/Parcel: 28/101 Account #: 06595311
Beginning at a point located on the west side Britton Street which is 76 feet from a point located in the line of Bigley Avenue; thence away from Britton Street, N. 87° 15' W. 100 feet to a pin common rear corner of property owned, or formerly owned, by Elmore Advent Church and Lee Craig; thence along the rear line, N. 2° 45' E. 29 feet to a pin common real corner to the property hereby conveyed and Lots 4 and 5 Block "M" of the Glen Elk City property; thence along the common line of Lots 5 and 6 of said property, S. 87° 15' E. 100 feet to a pin located on Britton Street; thence along Britton Street, S. 2° 45' W. 39 feet to the place of beginning; and being part of Lots 5 and 6, Block "M" Glen Elk City as shown on a map made by J. Beginning at a point in the westerly side of Britton Street, formerly Bridge Street, 115 feet in a northerly direction from the northwest corner of Bigley Avenue, formerly Elk Street, and Britton Street, formerly Bridge Street; thence in a northerly direction with the westerly line of Britton Street in a direction toward Crescent Road, formerly called the County Road, a distance of 52 feet 6 inches to a point; thence in a westerly direction on a line parallel with the line of Crescent Road, formerly the County Road, a distance of 100 feet to a stake; thence in a southerly direction with a line parallel to Britton Street a distance of 52 feet 6 inches to a stake; thence in an easterly direction 100 feet to a point in the westerly line of Britton Street to the place of beginning, and being a part of Block "M" as shown on a map of the property of Glen Elk Company of record in the aforesaid Clerk's Office in Map Book 2, at page 3.

Beginning at a point in the northern revised controlled access right of way line, said point being in the northern original controlled access right of way line and in the division line between trustees, Elmore Memorial Advent Church and the Department of Highways and 152 feet left of and at right angle to I-77S to I-64W baseline station 471 + 83, project I-77-3(66)100, Kanawha County, West Virginia; thence 2° 45' E. (deed) with said division line and said original right of way line of 12 feet, more or less, to a point in a common corner to trustees, Elmore Memorial Advent Christian Church, Ada C. Parker and the Department of Highways, said point being 164 feet left of and at right angle to baseline station 471 + 87; thence S. 87° 15' E. (deed) with the division line between Ada C. Parker and the Department of Highways, and with said original right of way line 35 feet, more or less, to a point in the northern revised controlled access right of way line, said point being 152 feet left of and at right angel to baseline station 472 + 20; thence, southwesterly in a reverse centerline direction parallel to centerline with said revised right of way line 37 feet to the place of beginning and containing 210 square feet, more or less.
Being the same property conveyed unto Kathryn M. Robinson, by deed dated December 7, 2011, from Branch Banking and Trust Company, and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 2809, at Page 303.
This conveyance will also be made subject to any and all reservations, exceptions, restrictions, rights of way and easements contained in prior deeds affecting said property of record in said Clerk's office or visible on the ground.
This property will be conveyed by Trustee together with the hereditaments thereof and all building, structures and improvements now or hereafter situate thereon and all fixtures, materials, supplies, equipment, machinery and other property as is now or may hereafter be an accession thereto, be a fixture thereto, or be otherwise treated or deemed as a part of the land described herein, all of which is included in the term "property" as used herein. By way of example and not by way of limitation, such fixtures and accessions shall include heating, cooling and air-conditioning units, plumbing and electrical fixtures and equipment, built-in appliances of every kind, boilers, machinery, motors, wall-to-wall carpeting, storm doors and windows, awnings and all furnishings attached to the property.
The above-described real estate will be conveyed by the undersigned Trustee to the purchaser by deed containing a Covenant of Special Warranty and subject to all liens, reservations and exceptions appearing in the record of title, and to the lien of all unpaid taxes, if any, which are entitled to priority over the lien of the aforesaid deed of trust. Purchaser must pay all transfer taxes, delinquent or current real estate Ad Valorem Taxes, title search and any costs related to recording of any Deed from the Trustee herein.
TERMS OF SALE
Any successful bidder shall pay 10% of the sales price as a deposit in Certified Funds or Cash at the time of sale with the balance to be paid within 30 days from date of sale. The above-described real estate will be sold by the undersigned Substitute Trustee by auction to the highest bidder subject to the right of the Trustee to reject all bids if in his opinion they are inadequate. The owner of the indebtedness secured by the above-described deeds of trust and the owner of any other interest in the properties to be sold shall have the right to bid.
CONTINUANCE OR ADJOURNMENT OF SALE
The Substitute Trustee reserves the right to continue the sale, or adjourn the sale for a time, or from time to time, and the place of sale, as hereinabove set forth, or any continuance or adjournment thereof.
