OPERATIONS

Notice is hereby given that Covington Coal Company, P.O. Drawer C Marmet, WV 25315, (304) 595-2535 surface mine permit number S-5017-02 situated in Peytona District of Boone County, approximately 1.2 miles Northeast of Ashford, will be conducting blasting activities in accordance with all State and Federal Laws and as approved by the Department of Environmental Protection.
All Blasting shall be conducted in accordance with the following schedule of dates and times, unless emergency conditions dictate unscheduled detonation. Blasting will be conducted between sunrise and sunset (approximate daylight hours) during November 15, 2016 to November 15, 2017.
Ten minutes prior to and immediately after each blast, all access to the specific area will be safeguarded from unauthorized entry. The warning signal prior to each blast shall be from an air horn, audible to at least one half mile from the blast. The warning will be given three (3) minutes prior to detonation and will consist of three (3) short blasts of five (5) seconds duration with five (5) seconds between each blast. The all clear signal shall be one long blast from an air horn of twenty (20) seconds duration.
Blasting shall be conducted in such a way so as to prevent injury to persons, damage to public or private property outside the permit area, adverse impacts on any underground mine, and change in the course, channel, or availability of surface or groundwater outside the permit area. Blasting activities will not be conducted at times other than those announced in the blasting schedule except in the event of an emergency situation where rain, lightning, or other atmospheric conditions, or operator or public safety requires unscheduled detonations.

Contract No. 1 - Construct T-Hangar Taxilanes
The bid prices shall include the costs for furnishing labor and materials and performing all work set forth in the Advertisement for Bids, Information for Bidders, Form of Proposal, Standard General Conditions of the Construction Contract, Supplemental General Conditions and Detail Specifications and Drawings prepared by Chapman Technical Group. Immediately following the scheduled closing time for the receipt of bids, all proposals which have been submitted in accordance with the required provisions will be publicly opened and read aloud.
The work to be bid upon is generally described as follows:

Contract No. 1 - Construct T-Hangar Taxilanes
The scope of the proposed project is to construct two sections of asphalt taxilane to provide access to a recently constructed 10-unit T-hangar at the Appalachian Regional Airport. The project will include approximately 1,500 cubic yards of select fill, 685 cubic yards of FAA specification P-209 crushed aggregate base course, 800 tons of WVDOH specification hot-mix asphalt pavement. The project will also include all necessary appurtenances and incidental construction necessary for a complete project as detailed in the plans and specifications prepared by Chapman Technical Group.
Construction Time Limits - The Contractor will be required to achieve Substantial Completion within 60 calendar days and Final Completion and Readiness for Final Payment within 75 calendar days of the effective date of the Notice to Proceed. Liquidated Damages will be $3,000 per day for each day after the expiration of the construction time.

Online access to procurement and contracting documents will be provided through Chapman Technical Group's Newforma software. Digital/electronic copies will not be available without purchase of at least one full-size set.
Each prospective Bidder shall be required to purchase a minimum of one copy of the Bidding Documents and be subsequently included on the Engineer's official bid register. They consist of plans, specifications and a bid submittal packet. The bid submittal packet provides an unbound copy and listing of the items which are to be submitted with the Bid. Bids received from Bidders not included on the official bid register will be declared non-responsive and returned to the Bidder.
Bidders are advised that a two envelope system will be used. Each bid must be submitted in a sealed main envelope containing the Bid Bond, WV Contractor's License, Contractor's Statement of Qualifications, and all other necessary documents as required on the bid opening checklist developed by the Engineer, and a separate sealed envelope inside the main envelope marked "Bid Proposal" containing the completed and signed bid (Form of Proposal).
The main envelope will be opened first and if the required documents are included and appear to be in order, the envelope containing the bid will then be opened and publicly read aloud. If the required documents are not included as part of the bid submittal, the envelope containing the bid will not be opened and the bid will be considered non-responsive and will be returned to the Bidder.

A Bidder may not withdraw his/her bid for a period of (90) days after the date set for opening of bids.

Bids shall be accompanied by a certified check or bid bond payable to the Mingo County Airport Authority, Williamson, West Virginia, in an amount not less than five percent (5%) of the Base Bid.

Bidders must comply with the Buy American preference requirements contained in 49 USC §50101. Bidders are required to submit certifications of compliance with their bid.

By submitting a bid, Bidders are certifying that neither it nor its principals are presently debarred or suspended by any Federal department or agency in accordance with 2 CFR Part 180 (Subpart C), 2 CFR Part 1200 or DOT Order 4200.5.

By submitting a bid, Bidders are certifying that they are compliant with the Trade Restriction contract provisions contained in 49 CFR Part 30.

Nondiscrimination in Employment - Bidders on this work are required to comply with the President's Executive Order Number 11246 and the provisions of executive order number 10925 as included therein. The requirements for Bidders and Contractors under this order are explained in the specifications.

Bidders must comply with the minimum rates for wages for laborers and mechanics as determined by the Secretary of Labor in accordance with the provisions of the Davis Bacon Act.

All prospective Bidders are encouraged to attend a
Pre Bid Conference to be held at the Appalachian Regional Airport, Varney, West Virginia, at 1:30 P.M., April 4, 2017, for the purpose of discussing the project and touring the site. Bidders are advised they will be required to register with the coal mine security station located at the main gate to receive access to the site. All Bidders will meet at the security station and then travel to the project site.

The Authority has established a Disadvantaged Business Enterprise (DBE) Program in accordance with the requirements of the U.S. Department of Transportation (DOT). As a recipient of funding from the DOT, the Authority signed an assurance to comply with the provisions of 49 CFR Part 26, "Participation by Disadvantaged Business Enterprise in DOT Programs."

This project, due to the amount of federal participation, requires the Contractor to meet a goal for Disadvantaged Business Enterprise participation of
8.5 percent (8.5%). The Contractor will be required to justify the amount of DBE participation which will be utilized or that there was a good faith effort made to allow for DBE participation. It is the policy of the Authority that DBE's, as defined in 49 CFR Part 26, shall have the maximum opportunity to participate in the performance of contracts assisted in whole or part by funds granted by the DOT.

The Owner's award of this contract is conditioned upon Bidder or Offeror satisfying the good faith effort requirements of 49 CFR §26.53.

As a condition of bid responsiveness, the Bidder or Offeror must submit the following information with their proposal on the forms provided herein:

(1) The names and addresses of Disadvantaged Business Enterprise (DBE) firms that will participate in the contract;
(2) A description of the work that each DBE firm will perform;
(3) The dollar amount of the participation of each DBE firm listed under (1)
(4) Written statement from Bidder or Offeror that attests their commitment to use the DBE firm(s) listed under (1) to meet the Owner's project goal;
(5) If Bidder or Offeror cannot meet the advertised project DBE goal; evidence of good faith efforts undertaken by the Bidder or Offeror as described in appendix A to 49 CFR Part 26.

The successful Bidder or Offeror must provide written confirmation of participation from each of the DBE firms the Bidder or Offeror lists in their commitment. This Bidder or Offeror must submit the DBE's written confirmation of participation within 5 days after bid opening.

The requirements of 49 CFR Part 26 apply to this contract. It is the policy of the Mingo County Airport Authority to practice nondiscrimination based on race, color, sex or national origin in the award or performance of this contract. Notice is hereby given by the West Virginia Department of Transportation, Division of Highways, that engineering consulting services will be utilized for the performance of various tasks to be performed under the following Statewide (On Call) Agreement:

Statewide Railroad Engineering Services - Consulting services will be utilized to provide engineering services for railroad, railroad bridge, and miscellaneous railroad projects. The work generally consists of structural inspections, preparation of contract plans and related documents.

Multiple firms may be selected for this work.

Firms interested in being considered for either of these projects must submit a "Letter of Qualification" for each project and one unpriced prospectus to Mr. Michael D. Lilly, P. E., Section Head, Technical Section, Engineering Division, Division of Highways, 1334 Smith Street, Charleston, West Virginia 25301 or
preferably by email to doh.consultantservices@wv.gov prior to 4:00 p.m. on April 10, 2017.

As a minimum, the prospectus shall include the following evaluation information factors:

1. Professional qualifications necessary for consideration and satisfactory performance of the required work and as a minimum shall have a professional engineer licensed by the State of West Virginia. That person shall be located within the office where the work is to be performed, and shall demonstrate sufficient past experience performed for the State of West Virginia, Department of Highways related to design and plan development to be provided. This individual shall be the person-in-charge overseeing the work and must be readily accessible to the Department, preferably located in-state.
2. Consideration shall be given to specialized experience and technical competence. Specialized experience shall focus on the qualifications of the staff working on the project with emphasis placed on individual specialized expertise required for the project. As a minimum, the firm shall provide a Résumé of those individuals who will be committed to the needs of the project. Strong considerations will be based on the professional and non-professional staff specialized experience and technical competence stationed within the office where the work is to be performed.
3. Capacity consideration shall be made on the firm's ability to accomplish the work within the Department's required schedule time frame; personnel dedicated to perform such work.
4. Past performance on contracts with Government agencies and private industry in terms of cost control, quality of work, and compliance with performance schedules.
5. Location shall be based on the geographic location of the Consultant's office relative to the project site along with past experience and knowledge of the area where the project site is located with the significant importance being given to accessibility of the office location relative to the Department.

In addition to the above evaluation factors, the prospectus shall include, as a minimum, the following items:

1. A completed copy of the Division's Consultant Confidential Qualification Questionnaire dated January 1, 2017 or later, if not already on file. It must specifically indicate the staff levels by classification located in-state vs. out-of-state. It must also indentify the person in-charge overseeing the work that holds a valid professional license issued by the West Virginia Board of Professional Engineers.
2. Location of office or office(s) in which the work, or part of the work, will be performed.
3. Identification of subconsultants by name as to the type of work anticipated to be subcontracted or performed, if proposed as part of the design team.
4. Indication of whether a cost accounting system has been maintained and is in effect such that it is capable of segregating and identifying accumulating costs for each job that is performed under cost type projects.
5. Completed copies of the Division's "Consultant Short List Selection Criteria Technical Evaluation" form limited to a single page of data. One loose leaf copy of form is to accompany the bound unpriced prospectus. Cross referencing on this form to other parts of the prospectus is not acceptable.
6. A copy of a valid "Certificate of Authorization" to offer Engineering, Surveying, or other related services within the state, issued by the appropriate West Virginia Board.

A
single "Letter of Qualification" and one unpriced prospectus are required and must contain all of the above information required to be considered. Failure to provide the required information and/or insufficient information will cause disqualification and the prospectus will be returned. All evaluation factors as noted herein before will be given equal consideration in the selection process, unless a project specific weighting of the evaluation factors is shown in the Notice for Consulting Services.

Prior to entering into any contract negotiations, the selected firm and any subconsultants shall submit a current audited overhead rate computation performed by a State or Federal government agency or independent CPA firm. The submitted overhead audit shall contain a detailed exhibit of the computations with all applicable eliminations and references. The audit shall be done in accordance with
Government Auditing Standards issued by the Comptroller General of the United States and all eliminations required by the Federal Acquisition Regulations will be made. The submitted certified audited overhead (Indirect Cost Rate) report shall include the certification, certifying that the allowability of costs used to establish the final indirect cost rate are in accordance with the FAR cost principles, or a verification indicating this certification was previously submitted and accepted by the cognizant agency. This requirement will be waived for the selected firm or any subconsultant when its portion of the fee for the project is less than Two Hundred Fifty Thousand Dollars ($250,000.00). In such instances, a company computed overhead rate may be utilized.

Installation must allow for at least four (4) spaces for wheelchair or other mobility device parking, so as to not block any walkway, aisle or designated path for egress. Bidder must cooperate with carpet installers (carpet installation will be bid out separately) to ensure favorable results.

Seating must be as specified or similar, durable, safe and be warranted against defects in material and workmanship for a minimum of 25 years. Bid must include all expenses including delivery, installation, hardware, removal/disposal of excess pews.

BY MUNICIPALITIES
The Town of Glasgow Water Department has adopted a Water Rate increase, on January 17, 2017 by ordinance a tariff of 32 percent increase effective April 1, 2017.
NOTICE is hereby given that the Town of Glasgow public utility, has adopted by ordinance on October 14, 2017 a tariff containing increased rates, tolls and charges for furnishing water service to 325 customers at Glasgow in the county of Kanawha.
The proposed increased rates and charges will become effective April 1, 2017 unless otherwise ordered by the Public Service Commission and will produce approximately $23,000 annually in additional revenue, an increase of 32%. The average monthly bill for the various classes of customers will be changed as follows:

The increases shown are based on averages of all customers in the indicated class. Individual customers may receive increases that are greater or less than average. The Commission shall review and approve or modify the increased rates only upon the filing of a petition within thirty (30) days of the adoption of the ordinance changing said rates or charges, by:
(1) Any customer aggrieved by the changed rates or charges who presents to the Commission a petition signed by not less than twenty-five percent of the customers served by such municipally operated public utility; or
(2) Any customer who is served by a municipally operated public utility and who resides outside the corporate limits and who is affected by the change in said rates or charges and who presents to the Commission a petition alleging discrimination between customers within and without the municipal boundaries. Said petition shall be accompanied by evidence of discrimination; or
(3) Any customer or group of customers who are affected by said change in rates who reside within the municipal boundaries and who present a petition to the Commission alleging discrimination between said customer or group of customers and other customers of the municipal utility. Said petition shall be accompanied by evidence of discrimination.

The reconfiguration/consolidation of New River Elementary School students to create a 3-5 elementary school which will maintain its grade 3-4 students and will accommodate the influx of students in grades 3-5 as a result of the closure of Mount Hope Elementary School, the influx of students in grades 3-4 as a result of the closure of Rosedale Elementary School, and the influx of grade 5 students from the reconfiguration of Collins Middle School at the close of the 2019 school year. The creation of a New Oak Hill PK-2 to accommodate the influx of all students in grades PK-2 from Rosedale, Mount Hope and New River Elementary Schools at the close of the 2019 school year, or later if the completion of the new school is delayed, which will be located on the Oak Hill Campus. Some Mount Hope Elementary School students grades PK-5 will attend Bradley Elementary School in Raleigh County.

The closure of Fayetteville and Gatewood Elementary Schools at the close of the 2019 school year. The closure/reconfiguration/consolidation of Fayetteville High School which will be renovated to create a PK-8 school, maintaining its grade 7-8 students and accommodating the influx of all students due to the closure of Fayetteville Elementary School (PK-6) and Gatewood Elementary School (K-4) with the 9-12 students from Fayetteville High School attending Oak Hill High School, all at the close of the 2019 school year.

The closure of Meadow Bridge High School at the end of the 2019 school year, beginning with the 2020 school year, students who are currently in grades 9-12 at Meadow Bridge High School will attend Midland Trail High School or Greenbrier West High School in Greenbrier County. Meadow Bridge Elementary School will be maintained and reconfigured to a PK-8 and consolidated by combining all students from Meadow Bridge Elementary grades PK-6 and the influx of students in grades 7-8 from Meadow Bridge High School resulting from the Meadow Bridge High School closure at the end of the 2019 school year. The existing 1977 and 1987 addition to the Meadow Bridge High facility will be utilized by the middle level students, beginning with the 2020 school year, while awaiting the construction of a new PK-8 school. In a second phase, a new PK-8 school will be constructed to house all students from the reconfigured and consolidated Meadow Bridge PK-8 School.

The closure of Valley Elementary School at the close of the 2019 school year. The closure/reconfiguration/consolidation of Valley High School, which will be renovated to create a PK-8 school and maintain its grade 6-8 students and accommodate the influx of all students due to the closure of Valley Elementary School (PK-6), with the 9-12 students from Valley High School attending Oak Hill High School, Midland Trail High School or Riverside High School, all at the close of the 2019 school year.

The vote on all school closures will be conducted at the conclusion of the final public hearing.

SUBMISSION OF WRITTEN MATERIALS: Written materials may be submitted for consideration by the Board. Written materials must be physically received in the Office of the Superintendent, 111 Fayette Avenue, Fayetteville, West Virginia 25840-1299, by the end of business on May 16, 2017.
PUBLIC PARTICIPATION: Members of the public may be present, submit statements and testimony and question county school officials. Members of the public who desire to submit statements and testimony or to question county school officials shall be afforded an opportunity to register beginning one hour prior to the start of the public hearing and ending at the start of the public hearing. Persons shall not be permitted to register at any reconvened public hearing sessions. Persons shall be called upon in the order of registration. All questions shall be initially directed to the Superintendent who may answer the question or designate another school official to address the question. Based upon the number of persons who register, the Board may limit, in a uniform manner, the time allotted to each individual. However, the time allotted may not be limited to a period of less than three minutes. Registered individuals may not assign or relinquish their allotted time to another individual. This contract is located in Mercer County. The project consists of retrofitting truss members with section loss, replacing the pier access ladders and retrofitting the inspection walkway on Bridge 3010S (Mile 17.52).

A MANDATORY PRE-BID meeting will be held on April 5, 2017 at 10:00 am at the Mile 17 Bluestone Travel Plaza south of the Bluestone Bridges. The Bidder must have a permanent full time employee in attendance.

Proposals will be received at the office of the West Virginia Parkways Authority, Administration Building, Charleston, West Virginia until
3:00 PM April 20, 2017, at which time and place said proposals will be publicly opened and read. If proposals are to be mailed via the U.S. Postal Service regular mail, they must be addressed to the West Virginia Parkways Authority, P.O. Box 1469, Charleston, WV 25325. This mail is picked up by the Authority once a day between 7:00 AM and 8:00 AM. However, Express Mail One Day Service, Federal Express, United Parcel Service (UPS), etc., must be sent to the West Virginia Parkways Authority, 3310 Piedmont Road, Charleston, WV 25306. It shall be the bidder's responsibility to determine his transmittal method such that his bid will arrive in the Authority's office prior to the scheduled bid opening.
