The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust dated October 9, 2009, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed of Trust Book 3683, at Page 942, Matthew S. Criswell and Staci N. Criswell did convey unto George A. Metz, Jr., Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk's Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse, in Charleston, West Virginia, on Monday, August 28, 2017,

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Charleston South Annex District, Kanawha County, West Virginia, and more particularly described as follows:
All that certain lot, parcel, or tract of land, together with the improvements thereon and appurtenances thereunto belonging, situate in the City of Charleston, Charleston South Annex, Kanawha County, West Virginia, and being all of Lot 10 of Royal Oaks Subdivision, as the same is shown upon that certain plat entitled, "Final Plat of ROYAL OAKS Showings LOTS 1 THRU 14 (incorrectly shown as Lots 2 Thru 14 in that certain deed dated May 10, 2006, from Primacy Closing Corporation, a Nevada Corporation, to Michael A. Rossiter, of record in the Office of the Clerk of the County Commission, Kanawha County, West Virginia, in Deed Book 2662, at page 351) Located at 1516 Connell Road in the City of Charleston, South Annex, Kanawha County, West Virginia, Made by William J. Whitman, R.P.S.", dated April 27, 1990, and of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Photostatic Map Book (Cabinet) 45, at page 20, together with all rights of way and easements shown upon said map pertinent to and for the benefit of the property herein conveyed, including that certain 30 foot easement for ingress and egress as set forth and designated in Deed dated October 26, 1989, from Royal Land Corporation to Benchmark Construction Company, Inc., of record in the aforesaid Clerk's Office in Deed book 2236, at page 278, and being a part of the same property as was conveyed by said Deed.
This conveyance is made subject to those reservations, conditions, and easements shown upon said map and is further made subject to those certain restrictive covenants entitled, "Declaration of Covenants, Conditions, and Restrictions, Roya Oaks", of record in the aforesaid Clerk's Office in Deed Book 2236, at page 11, as amended by instrument dated April 2, 1991, of record in the aforesaid Clerk's Office in Deed Book 2268, at page 303.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1522 Royal Oaks Road, Charleston, WV 25314.
AND BEING the same real estate which was conveyed to Matthew S. Criswell and Staci N. Criswell by Deed dated April 3, 2009, from Michael A. Rossiter, and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 2755, at Page 804.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
